 As the charge was admitted, the Committee found the charge proved.

Penalty:

Mr Chan is suspended from the conclusion of racing on Saturday 10 September until the conclusion of racing on Saturday 24 September. This is a total of four (4) days and incorporates the Wanganui (15th), Hawke’s Bay (17th), Otaki (22nd) and Taranaki (24th) meetings.

Facts:

Following the running of Race 4 (CORO ANGEL SYNDICATE OPEN 1200), Information A6843 was filed with the Judicial Committee. It alleged a breach of Rule 638(1)(d) by Apprentice A Chan. The Information stated: ”A Chan shifted ground in the home straight causing interference to NORTH AND SOUTH, HEAVENS KEEP and SCAPOLO.”

Rule 638(1)(d) states:
“A Rider shall not ride a horse in a manner which the Judicial Committee considers to be: … (d) careless.”

Mr Chan was assisted at the hearing by Licensed Trainer, Mr Sharrock. Mr Chan confirmed to the committee that he understood Rule 638(1)(d), and that he admitted the breach.

Using the head-on, side-on and rear-view films, Mr Whiterod identified Mr Chan’s horse (GYPSY FAIR) racing to the inside of NORTH AND SOUTH (M Tanaka), HEAVENS KEEP (J Parkes) and SCAPOLO (Z Moki) approaching the final 100 metres. SCOPOLO was the widest of all four runners. Mr Goodwin alleged that Mr Chan had attempted to improve his mount seeking an inside run, which was no longer available to him. He had then taken his mount towards the outside, and in doing so was not clear, causing tightening to those three runners located to his outside. In response to a question from the committee, Mr Goodwin believed Mr Chan was only ¾ Length clear when angling outwards.
Mr Chan and Mr Sharrock had no comments to make regarding the incident when invited to do so.

Submissions for Penalty:

In presenting Mr Chan’s record, Mr Goodwin identified that Apprentice Chan had one suspension within the last 12 months; on 17 July at Oamaru for two days. The Stewards believed the level of carelessness, while appearing slightly dramatic, could be classified as “not severe”, but had caused tightening to runners on the outside. He submitted a period of suspension would be appropriate.

Mr Sharrock indicated that Apprentice Chan had riding engagements up until Saturday 10 September. He stated that he had been apprenticed to him for the last three weeks and that while there had been a pattern of previous riding in the South Island, he would predominantly be riding in the Central Districts.

Reasons for Penalty:

The committee had regard to all of the submissions put before it. The films clearly demonstrate that that Mr Chan sought to improve to the inside as he was approaching the 100 metres. As that run did not eventuate, he then angled towards the outside of the field, without looking to see if he was the required distance clear. The carelessness on his part led to significant tightening to the runners on his outside (NORTH AND SOUTH, HEAVENS KEEP and SCAPOLO) over the concluding stages. Accordingly, we placed the level of carelessness within the mid-range and believed that a period of suspension was an appropriate penalty to impose on this occasion, and adopted a starting point of five days. In mitigation, the committee considered Mr Chan’s early admittance of the breach. We also noted that his previous period of suspension was imposed seven weeks ago. On balance, it was decided that a four day period of suspension would be appropriate. The committee also consented to a deferment of the suspension in order to allow Mr Chan to fulfil riding engagements on Saturday 10 September.
