As Miss Johnston has admitted the breach the committee find the charge is proved.
Penalty:
The committee impose a term of suspension from the close of racing on Saturday 5th February up to and including Friday11th February, (3 days) Waipa, Southland, and Taranaki.
Charge:
Following race eight an information was lodged alleging that V Johnston permitted her mount Cherry Express to shift in rounding the first turn when not clear causing tightening to Pop Ya Belt (K Smith) which was checked.
Rule 638 (1) (d): (1) A rider shall not ride a horse in a manner which the Judicial Committee considers to be: (d) careless.
The rule was read and confirmed.
Facts:
Mr Goodwin using the head and side on films indicated where approaching the first turn, Pop Ya Belt (K Smith) racing adjacent to the running rail had Cherry Express on the outside, and at this point Cherry Express shifts in causing Pop Ya Belt to check and loose approximately two lengths. Mr Goodwin informed the panel he had spoken to Mr Smith in regard to the alleged incidence .Mr Smith informed the stewards Pop Ya Belt did not help matters by racing unkindly at that stage of the race which was accepted by the stewards, confirming to the committee Pop Ya Belt did race in an awkward manner in the early part of the race. However Miss Johnston looks in, moves in, is called to, and releases the pressure, albeit to late as Pop Ya Belt is checked. Miss Johnston was only one to one and a half lengths clear when moving in.
Miss Johnston informed the committee that her mount is a wayward type racing for the first time in side winkers .Mr Smith indicated to her his horse was racing ungenerously and needed her horse to help him get around the bend. Miss Johnston confirmed she did move in slightly, got a call and immediately released the pressure.
Submissions for Penalty:
Mr Goodwin confirmed an excellent riding record showing February 2010 being the last occasion Miss Johnston breached the careless riding rule with a four day penalty. This may have been an error of judgement, and the stewards’ submission is this offence is deemed at the lower end of the scale and seek a penalty of suspension.
Miss Johnston informed the committee of her riding engagements up to Saturday 5th February and confirmed she rides in both Islands, and asked that her good riding record be taken into consideration.

The committee have taken into account the early admission of the breach by Miss Johnston and also her excellent riding record in regard to rule 638 (1) (d). Commencing with a guideline of five days in regard to a suspension the committee have taken the above submissions, and include the degree of carelessness to be at the lower end of the scale, one horse was affected and Miss Johnston’s immediate reaction to release the pressure.
Miss Johnston was never the required distance clear of Pop Ya Belt when moving in resulting in that horse loosing two lengths. The offence is at the low end of the scale and to be consistent with previous penalties shall be dealt with by way of a suspension.
