As the breach was admitted the charge was found to be proved.

Penalty:

Balancing up all of the relevant factors it was our opinion that a monetary penalty of $500 was an appropriate penalty for today’s breach.

Facts:

Following Race 6, the Wanganui Chronicle 1340, an information was lodged by the Stewards alleging a breach of Rule 638(3) (b) in that J Parkes used his whip excessively prior to the 200m when riding SO IT GOES.

Mr Jones played videos of the incident which showed Mr Parkes strike his mount 10-11 times from the home bend up until the 200m mark. Mr Parkes did not give the required 6 stride respite as provided for within the guidelines. Mr Parkes accepted Mr Jones' interpretation of the films and had nothing further to add.

Submissions for Penalty:

Mr Goodwin described Mr Parkes’ record as “unfortunate” with regards to excessive use of the whip. He was fined $400 in September at Hawkes Bay and $1000 in March for excessive use in the New Zealand Oaks at Trentham.

Mr Goodwin said that Mr Parkes had been making a concerted effort to monitor his whip use however from time to time, as was the situation today, he slipped up. The Stewards’ submission was for a $500 fine.

Mr Parkes had no submissions to make on penalty.

Reasons for Penalty:

The committee took into account all of the submissions and referred also to the penalty guide. The recommended starting point for a second breach within a year is a suspension of two riding days or a $500 fine. Mr Parkes has had two previous charges this year however the committee had regard to the large number of rides he has had within this time frame. We gave him credit for his admission of the breach and we also considered other recent penalties imposed under this rule. Mr Parkes was strongly reminded of the importance the racing industry placed on animal welfare and of his obligation to ride within the recommended guidelines.
