As Mr Riddell admitted the breach we found the charge proved.

Penalty:

Accordingly Mr Riddell’s license is suspended from the close of racing on Monday April 2nd up to and including racing on Sunday April 8th.

Facts:

Following the running of Race 5 (NZB Insurance Pearl Series F&M 1340), an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1)(d) in that jockey J Riddell allowed his mount BALLET CHOUX to shift outwards when not sufficiently clear of HELENAOFTROY which was tightened.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Riddell confirmed to the Committee that he understood the charge and that he admitted the breach.

Mr Goodwin played all the available views of the incident which occurred near the 200m. The head-on view showed Mr Riddell riding vigorously when he shifted outwards approximately three horse widths into the rightful line of Ms Rosie Myers. Ms Myers was not checked as such but she lost some ground as a result of Mr Riddell’s actions.

Mr Riddell admitted to letting his mount drift outwards and said while he was aware of the riders to his outside he did not notice Ms Myers in behind.

Submissions for Penalty:

Mr Goodwin produced Mr Riddell’s riding record which showed the following careless riding suspensions:
3/3/18 - Ellerslie 5 days
24/2/18 - Matamata 7 days
21/1/18 - Te Rapa 5 days

He said the Stewards placed the degree of carelessness in the low range. Mr Riddell could have done more to straighten his mount but the interference to Ms Myers’ mount was minor. His submission was for a period of suspension.

Mr Riddell said that Ms Myers’ mount was tiring at the time. He advised of riding commitments through until Monday April 2nd.

Reasons for Penalty:

The Committee had regard to all of the submissions. In assessing the degree of carelessness we note that Mr Riddell was 1 length clear of Ms Myers when he moved into her line of running. He is required to be his length and one other clear before moving in front of another runner. Ms Myers was forced to ease but her safety was not compromised and we accept that her mount was tiring at the time. We assessed Mr Riddell’s carelessness to be low end and adopted a starting point of 6 days.
On the face of it Mr Riddell’s riding record does not look good with suspensions for careless riding in January, February and March however prior to January Mr Riddell’s last charge had been in January 2017. Putting it into context Mr Riddell has had 3 charges in 12 months which is not a poor record for a busy rider. On this occasion we treated Mr Riddell’s record as neutral.

For his admission of the breach we allowed a one day discount imposing a five day suspension.
