Decision:

Following the running of race 3, the “Carters Gib 1340”, Mrs Allpress was charged with careless riding under rule 638 (1) (d).  The information alleged that Mrs Allpress “permitted her mount RIVERSTAR to shift inwards near the 1000 metres when not sufficiently clear of CALLA QUEEN (E Dalley) who clipped a heel and blundered”.

Following the running of race 3, the “Carters Gib 1340”, Mrs Allpress was charged with careless riding under rule 638 (1) (d).  The information alleged that Mrs Allpress “permitted her mount RIVERSTAR to shift inwards near the 1000 metres when not sufficiently clear of CALLA QUEEN (E Dalley) who clipped a heel and blundered”.

Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”

Mrs Allpress indicated on the information she admitted this breach of the rules.  She also agreed she understood the charge and the rule it was laid under.  As the breach of the rule was admitted the charge was proven.

Stipendiary Steward Mr Goodwin showed the head on and side on videos of the incident.  Mr Goodwin said Mr Dalley was two out from the fence and Mrs Allpress was on his outside.  At approximately the 1000m mark Mrs Allpress came across in front of Mr Dalley who was trying to restrain his mount to let her in.  In moving across Mrs Allpress, who was seen to be looking in, was not the required distance clear and Mr Dalley’s mount clipped a heel.

Mrs Allpress said she thought Mr Dalley was going to pull back as she came across.  She said she did here him call out but as she went to go she agreed she did not have enough room which resulted in the incident occurring.

Penalty Submission

Mr Goodwin said Mrs Allpress was a busy rider who rode throughout the country.  She had incurred two suspensions in the last month – at Hawkes Bay on 15 October (4 days) and at Woodville on 26 October (5 days).  He said that today she was unfortunate that she was not the required distance clear when moving across and he described the incident as “not at the top end”.  He indicated he thought a suspension of 4 days was an appropriate penalty.
 
Mrs Allpress had no comment to make other than that she wanted to request a 7 day deferment as she had a confirmed ride in the Group 1 race at Trentham on Saturday 5 December.

Decision

In coming to a decision on penalty the Committee considered the incident as shown on the video and all the submissions put before it as well as Mrs Allpress’ admittance of the breach. The video clearly shows that you were not sufficiently clear of CALLA QUEEN when you moved in causing that horse to clip a heel.  We believe, however, the incident is at the lower end of the scale.

Mrs Allpress is suspended from the conclusion of racing on Saturday 5 December 2009 until the conclusion of racing on Friday 11 December 2009, that being 4 riding days.
