CHARGES:

Following the running of race 6, information 5682 was filed by Stipendiary Steward Mr R Neal against Mr J Parkes alleging a breach of rule 638(1)(d).  The information stated that “J Parkes the rider of Gros Gri allowed his mount to shift in when not clear of Vamoose (J Riddell) which was dictated inward onto Anuthahabit (D Walker) which was checked near the 600m”.

Rule 638(1)(d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”

Mr Parkes indicated the breach of the rule was admitted and also that he understood the charge and the rule it was laid under.

FACTS:

--

Mr Neal showed the film of the race and pointed out Mr Parkes racing Âľ to 1 width off the rail approaching the 600m mark.  He said Mr Riddell was racing approximately 1 length behind and on the inside of Mr Parkes with a clear line of running when Gros Gri started to tire and move in.  As a result of Mr Riddell had nowhere to go and this led to him placing pressure on Anuthahabit and Mr Walker which was checked.  Mr Neal said that immediately after moving in Mr Parkes corrected his mount but by then the interference had taken place to both horses on his inside.  Mr Neal said he did not consider the interference was significant but because Mr Parkes was not aware of the horses on his inside he did take Mr Riddell’s rightful line of running and caused Mr Riddell to move down with the resulting check to Mr Walker.

Mr Parkes said his horse was tiring at the time of the incident and he conceded he had slightly moved in and put pressure on the inside horses but had straightened his mount and pulled off immediately he heard calling from Mr Riddell.

SUBMISSIONS ON PENALTY:

--

Mr Neal said the stipendiary stewards considered Mr Parkes to be a North Island rider who had an excellent riding record not having been charged under the careless riding rule in the previous 12 months.  He described the interference as being at the lower end and submitted  the stewards believed a penalty at the minimum end of the scale was appropriate.

Mr Parkes was invited to make his submissions on penalty and said he did not want to seek a deferment of a suspension should he be given one.

REASONS:

--

In coming to a decision on penalty the Committee has considered the films of the incident, Mr Parkes’s excellent riding record and his admission of the breach.  We agree he has allowed his horse, which was tiring at the time, to move in near the 600m mark when not the required length plus another clear of Mr Riddell’s mount and take his rightful line of running as a result of which Mr Riddell has then been moved inwards causing a check to Mr Walker on Anuthahabit.  We agree the interference to Mr Riddell was at the lower end but also note that the consequential check to Mr Walker was quite severe.

PENALTY:

--

The Committee have decided a period of suspension is appropriate in this case and Mr Parkes is suspended from the close of racing on Sunday 27 June until the close of racing on Wednesday 7 July - effectively 4 North Island riding days being Matamata (30 June), Egmont (2 July), Hawkes Bay (3 July) and Cambridge (7 July).
