Mr Riddell admitted the breach and was present at the hearing.

A film was shown of the alleged incident and interpreted by Mr George.

Mr Riddell had no questions of Mr George.
----
The film clearly showed Mr Riddell strike the horse over the head with his whip.
----
Mr George informed the Committee Mr Riddell had never previously been charged under the rule.
----
In submissions as to penalty Mr George told the Committee the incident was clearly shown on Trackside and that not only was it an ANIMAL WELFARE issue but was damaging to the image of racing.

Mr Riddell said he deeply regretted his actions.
----
When arriving at a penalty the Committee took into account it was Mr Riddell’s first charge under this rule, his admission of the breach, and his genuine remorse.

However any penalty must show disapproval and a warning to others that such actions will not be tolerated and a fine of $500 was felt appropriate.
