Decision: The information alleges that CW Johnson permitted his mount to shift out in the early part of the straight dictating BALTAINE outwards which resulted in RABKALAJO being crowded across the running of TRUE POWER which had to be checked.

The information alleges that CW Johnson permitted his mount to shift out in the early part of the straight dictating BALTAINE outwards which resulted in RABKALAJO being crowded across the running of TRUE POWER which had to be checked.  RABKALAJO was steadied a short distance later.

Mr Johnson was present at the hearing and admitted the breach.

The rule was read and Mr Johnson acknowledged he understood same.

--

Head-on and side on films were then shown of the alleged incident and interpreted by Mr George.

--

Mr Johnson had no questions of Mr George nor did he wish to give his interpretation of the films shown.

--

He did however comment that he did not realise how far he had drifted outwards until he had seen the films.

--

Mr George then gave the Committee Mr Johnson’s record which showed he had been charged under this rule 6 times since August last year, he felt the carelessness in this instance was at the top end of the scale having effected 2 horses and warranted a term of suspension.

The Chairman asked Mr Johnson to confirm his record as given to the Committee was correct he acknowledged it was, he also asked Mr Johnson to confirm that he was at a meeting earlier in the day when the Stipendiary Stewards had warned all riders of the dangers of going too wide looking for better ground when entering the home straight, he (Mr Johnson) confirmed he was.

The only commitments Mr Johnson had in the immediate future were this Saturday and Sunday.

Those present acknowledged they had nothing further to add and that they were happy they had a fair hearing and left the Judicial Committee to arrive at a decision as to penalty.

When arriving at a penalty the Committee took into account Mr Johnson’s admission of the breach and his co-operation with themselves and the Stipendiary Stewards.

--

 

--

These factors however were outweighed by the fact the carelessness was not minor and caused two horses to be checked and was Mr Johnson’s seventh charge under this particular Rule this season, and warranted a term of suspension of not less than 10 days.

--

Mr Johnson may ride until the conclusion of racing on the 27th of July 2008 and is then suspended until conclusion of racing on the 15th of August 2008 in effect 10 days.
