Due to the committee’s determination the charge preferred under Rule 636(1)(d) was proved.

Penalty:

Mr Perrett’s Jockey’s Licence was suspended from the end of racing on 23 April 2015 up to the close of racing on 14 May 2015 (4 days).

The 4 days where there are opportunities for jumping and highweight jockeys to ride are:
30 April - Riverton
2 May - Waikato
7 May - Hawkes Bay
14 May - Otaki

Facts:

Following the running of Race 5 (The Lisa Latta Stables R65 & Jumpers Highweight 2060m) Information No. A2721 was filed with the Judicial Committee. The information alleged that Mr Perrett failed to ride his mount SIR GONZALES out to the line and was beaten for third place. (The margin was a short head).

Rule 636(1)(d) reads:
Being the rider of a horse in a race must ride his horse out to the end of the race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared.

Mr Perrett acknowledged that he understood the Rule and the charge and that he did not admit the breach.

Submissions for Decision:

Mr Goodwin showed the films and said that Mr Perrett had ridden his horse out up the straight and with 3 to 4 strides from the post and when still in third position, he relaxed his ride and was beaten for third placing by a short head.

Mr Perrett did not have any questions of Mr Goodwin.

Mr Goodwin was asked by the Chair if Mr Perrett had relaxed or stopped riding his mount out. He answered that he had stopped.

Mr Perrett for his part said that his horse SIR GONZALES was getting tired and if he had hit it one to two more times it would not have gone any better. He added that the heavier ground had an effect on his horse. Mr Perrett said that in his opinion he had been headed for third position when he stopped riding his horse out.

Informant Mr Whiterod said that SIR GONZALES had been hard-ridden and that when Mr Perrett stopped riding out that the horse shortened stride immediately.

Mr Perrett did not agree with that submission and said that other runners did not make ground on his horse after he stopped riding out.

Reasons for Decision:

The committee considered all of the evidence carefully and found that Mr Perrett had ridden his mount out fully up the final straight until the final few strides, when he clearly stopped riding his mount out. The committee was satisfied that SIR GONZALES was in third position when Mr Perrett ceased riding his mount out and was narrowly beaten for that placing. The margin between third and fourth was a short head.

Submissions for Penalty:

Mr Whiterod said that Mr Perrett had a very good record and that this was the first time he had been charged under the Rule. He said that similar breaches had been met with suspensions of approximately one month.

Mr Perrett did not have anything to say regarding penalty except that he asked that any suspension imposed start immediately.

Reasons for Penalty:

The committee in considering quantum of penalty took into account Mr Perrett’s very good record and the fact that there are limited opportunities throughout the season for jumping and heighweight jockeys. The committee was aware of other penalties imposed for similar breaches and believed that a 4 riding day suspension was an appropriate penalty on this occasion.
