Wanganui JC 19 February 2021 – R 3 – Chair, Mr N McCutcheon
ID: JCA16216
Code:
Thoroughbred
Meet Title:
Wanganui JC - 19 February 2021
Meet Chair:
NMcCutcheon
Meet Committee Member 1:
BMainwaring
Race Date:
2021/02/19
Race Number:
R 3
Decision:
Due to the charge being admitted together with the film evidence the breach was found proved.
Penalty:
Mr Dell requested a deferment of any suspension imposed until after racing on 27 February 2021.
Mr Dell’s Jockey’s Licence was suspended from the conclusion of racing on 27 February through to 11 March 2021 inclusive (5-Riding Days) and a fine of $250 imposed.
Facts:
Following the running of Race 3 (NZB Insurance Pearl Series) Information A14127 was filed with the Judicial Committee. It was alleged that Mr Dell permitted his mount MAKADOON to shift outwards when not sufficiently clear of SPANISH ANGEL which was checked near the 300m.
Mr Dell said that he understood the Rule and Charge and confirmed that he admitted the breach.
Mr Oatham identified the horses on the film replays and said that Mr Dell and his mount shifted out onto SPANISH ANGEL when less than 1 length clear. He said that the Rider of SPANISH ANGEL had to take evasive action to avoid heels.
Mr Dell in reply said that he is trying too hard to ride a winner and establish himself in the Central Districts.
Submissions for Penalty:
The record showed that Mr Dell had one breach only in the last 12 months, that being on 9 September 2020 when a 3-day suspension was imposed.
Mr Goodwin placed the carelessness in the mid-range and submitted that a term of suspension be imposed.
Reasons for Penalty:
Mr Dell angled his mount out near the 300m and in doing so took the line of SPANISH ANGEL when not clear. As a consequence of the shift the Rider of SPANISH ANGEL (B Ansell) was forced to take the necessary action to avoid heels.
The Committee placed the carelessness in the mid-range category. Taking into account the record and the JCA penalty starting point it was determined that a suspension of 5 Riding Days together with a fine of $250 was a suitable penalty.
