As the charge was admitted, the committee found the charge proved.

Penalty:

Miss Collett is suspended from the conclusion of racing on Sunday 18 September until the conclusion of racing on Sunday 25 September. This is a total of five (5) days and incorporates the Matamata (21st), Otaki (22nd), Gore (23rd), Auckland/Taranaki (24th) and Te Aroha (25th) meetings.

Facts:

Following the running of Race 6 (THE BOLD ONE @ GRANGEWILLIAM STUD MAIDEN 1360m), Information A6847 was filed with the Judicial Committee. It alleged a breach of Rule 638(1)(d) by Licensed Jockey Miss Alysha Collett. The Information stated: ”A Collett allowed her mount to shift in down the back straight and cause interference to STORMY RED and NEAT BELT”

Rule 638(1)(d) states:
“A Rider shall not ride a horse in a manner which the Judicial Committee considers to be: … (d) careless.”

Miss Collett confirmed to the committee that she understood Rule 638(1)(d), and that she admitted the breach.

Using the available films, Mr Whiterod identified Miss Collett’s mount (FOGARTY FEGEN) located to the outside of STORMY RED (N Teeluck), which was in turn racing on the outside of NEAT BELT (T Johnson). He submitted that soon after the start Miss Collett elected to angle her mount in, which did not cause any concern for stewards. However, she continued to seek a run closer to the running rail and shifted inwards, placing pressure on to STORMY RED when not sufficiently clear. This also resulted in pressure being placed on to NEAT BELT. Mr Whiterod pointed out that there appeared to be no movement from inside runners and that it was clear that all pressure came from the outside. He believed that the interference had been set up by Miss Collett’s inwards movement and that it was simply that she “just went too far”.
Miss Collett said she had clearly misread the situation. She had commenced an inwards movement and had rolled in an extra half width which resulted in the pressure being applied to those runners to her inside. She also believed that Mr Johnson’s inexperience may have led to the action he took, rather than a more experienced rider who may have read the situation better.

Submissions for Penalty:

In presenting Miss Collett’s record, Mr Goodwin identified three previous breaches of this rule within the last 12 months: 1 January at Ellerslie (4 days and $1,000), 5 March at Ellerslie (3 days and $1,000) and 24 August at Matamata (5 days). He believed she had intentions to run closer to the rail, but in doing so had caused tightening. As such, he submitted the carelessness fell at below mid-range and that a period of suspension would be appropriate.

Miss Collett disagreed with Mr Goodwin’s assessment of the carelessness, believing instead that it sat within the low-range. She believed the other mounts located to her inside had an effect on how the incident looked on the films. She also stated that she did relieve the pressure as soon as she became aware that there was an issue. She invited the committee to consider the possibility of a period of suspension along with a fine. Miss Collett asked for any period of suspension to commence as soon as possible. She also believed the upcoming Gore Meeting should be included in her suspension as she had recently ridden in the South Island and more specifically had ridden at the most recent Gore Meeting.

Mr Goodwin had no concerns with the Gore Meeting being included.

Reasons for Penalty:

The committee had regard to all of the submissions put before it. The films clearly show that Miss Collett had commenced an inwards movement soon after the start, seeking to gain a run closer to the running rail. In doing so, she had moved inwards half a width too much, which resulted in the inconvenience to Messrs Teeluck and Johnson. We independently assess the level of carelessness to sit within the mid-range. While Miss Collett had realised the implications of her swift inwards movement and had taken action and pulled off, by that stage the damage had been done. While Mr Johnson may not have as much riding experience as others, he was entitled to be where he was; instead, as a result of Miss Collett’s carelessness he had lost his position and received a check.

We reject the submission of a period of suspension along with a fine, as we believe a suspension is appropriate on this occasion. Adopting the JCA Penalty Guidelines starting point of five days, in mitigation we apply MIss Collett’s admission of the breach. Her record is an aggravating feature as this is the fourth breach of this rule, with the most recent breach occurring less than one month ago. We believe a five day period of suspension is appropriate. We note that Miss Collett wishes any period of suspension to commence immediately, and as riders for the Counties Meeting on Sunday 18th September had been declared it will commence at the conclusion of racing on that day. We are also satisfied, on the basis of information placed before us at the hearing, that the Gore Meeting should be included in any period of suspension.
