As Mr Kuru admitted the breach the charge is found proved.

Penalty:

Mr Kuru is suspended from the close of racing on Saturday 16 June 2018 to the close of racing on Friday 29 June 2018.

Facts:

Following the running of race 1, the “Liquorland Maiden Highweight”, Information A10395 was filed by Senior Stipendiary Steward, Mr M Williamson under Rule 638(1)(d). The Information stated “that A Kuru (Elamo) allowed his mount to shift inwards near the 1400m when not clear of “Wonderful Barbie “ and Wonder Lass which was checked”.
 
Mr Kuru signed the Information stating he admitted the breach and at the beginning of the hearing confirmed that was correct and that he understood the Rule under which he was charged.
 
Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”.
 
Using the available films Stipendiary Steward, Mr Goodwin identified Mr Kuru shortly after the start of the 1600m race racing close to the front of field and approximately 6 wide as the horses began to travel round the first bend. To Mr Kuru’s inside was “Wonderful Barbie” (S Fannin) and to that horse’s inside was “Wonder Lass” (J Sievwright). Mr Goodwin said Mr Kuru could be seen to angle his mount inwards to get a run closer to the rail when not the required distance clear of the runners to his inside which resulted in tightening to “Wonderful Barbie” with Mr Fannin being unable to relieve any pressure as a result of which he was dictated inwards onto “Wonder Lass” which was checked. Mr Goodwin said at the same time “Charlie Horse” (D Turner), which was down on the rail, was also not racing in a tractable manner but this had no bearing on the check received by “Wonder Lass”. To a question from the Committee Mr Goodwin said that after discussing the incident with Mr Fannin the Stipendiary Stewards believed Mr Kuru was barely a length in front of Mr Sievwright when he crossed over.
 
Mr Kuru said the 1600m start is a tricky start for all riders but conceded he had put the runners to his inside under pressure as he tried to “make the bend”. He added he thought he was the required distance clear at the time he came across and did not hear any calling out from those inside him.

Submissions for Penalty:

Mr Williamson said Mr Kuru had not been charged with a breach of the Rule in the previous 12 months. He said the Stewards viewed the severity of the interference in the mid-range or slightly below but in mitigation he said the 1600m start was a tricky one for all riders and even more so for those who only occasionally ride in 1600m races at this course which was the case for highweight and jumps riders.
 
Mr Williamson said the starting point penalty for a highweight/jumps rider was 3 days and that, taking into account Mr Kuru’s frank admission of the breach and noting that the quality of the films was not that great. a penalty of not less than 2 days should be imposed.
 
Mr Kuru asked the Committee to take into account his good riding record.

Reasons for Penalty:

The Committee has reviewed films of the incident which show that soon after the start Mr Kuru can be seen to angle his horse inwards from a position approximately 6 wide in an attempt to take up a position closer to the rail. The quality of all the films shown is not the best and whilst there is a gap between Mr Kuru and Mr Fannin as Mr Kuru comes across it is not the required 2 lengths as a result of which, Mr Fannin becomes cramped for room which in turn causes the check to Mr Sievwright. The Committee notes the submissions made relating to the “tricky start” and closeness of the first bend for 1600m races at the course and which can cause difficulties for riders who do not often ride in 1600m races at the course.

The Committee believes on this occasion a period of suspension is an appropriate penalty. We categorise the severity of the breach as being in the low range with the starting point for such a breach being a suspension of three national jumps/highweight riding days. From that start point we reduce the penalty by one national jumps/highweight riding day in recognition of Mr Kuru’s admittance of the breach and also his very good riding record. Mr Kuru is suspended for two national jumps/highweight riding days.
