The Committee‘s ruling is that the circumstances put before the Committee as detailed above are not enough to justify the 3 horses being scratched and Mr Vile is therefore not authorised to scratch them from their respective races.

Facts:

Prior to the running of Race 3 Stipendiary Steward Mr Balcombe filed Information A11610 seeking a ruling as to whether Trainer Mr G Vile's 3 remaining runners at the meeting could be scratched.

Submissions for Decision:

At the beginning of the hearing Mr Vile was asked if he understood the provisions of Rule 534 which allow the Stipendiary Stewards to seek a Ruling from the JCA as to whether (in this case) the request from Mr Vile that he be allowed to scratch the 3 horses after the scratching deadline of 7.30am this morning. Mr Vile said he understood Rule 534 and did not need to have it read out.

Mr Vile said after the running of Race 1 he had asked the Stewards for permission to scratch his runner in Race 3 and his 2 runners in Race 7 because of the very heavy nature of the track. He said the winning time in R1 - a 1600m Race - was 1.53.22 and in the interests and welfare of his horses and their riders he wanted to scratch. He said he was aware the track was rated as a Heavy 11 earlier this morning but since 7.30am there was more rain which had made the track very testing as was evidenced by the distance between the winner and the last horse in Race 1.

Mr Balcombe said the Stewards has opposed the request because in their view the state of the track had not materially altered since 7.30am. 12 mls of rain had fallen overnight and whilst it had rained since 7.30am he was unaware of how much. He conceded the track was very testing, as evidenced by watching the previous race, but added there was no surface water. He added that the jockeys spoken to after that Race had no concerns about the track or the weather conditions.

Reasons for Decision:

The Committee has considered the submissions put before it. We have reviewed the “wet weather statistics” of the 3 horses and note that 2 of them have previously been placed on a heavy track within the last month. Mr Vile was aware the track was rated a Heavy 11 prior to scratching time and whilst we are aware that it has rained on and off since 7.30am there was no evidence provided to us that there had been a material change in the condition of the track since that time.
