Decision:

Rule 871 (1) (d) : Mr Neal lodged an information alleging that in passing the1900 metres Apprentice Jockey B Lamas permitted his mount BEAU PRINCE to shift inwards crowding RICH REWARD (J Parkes) which had to be checked.

Mr B Lamas was questioned as to representation at the hearing.  Mr Lamas elected not to be represented.  Mr Neal confirmed that this had occurred on numerous occasions, and as a senior apprentice rider B Lamas was capable of representing himself if he so wished.
The committee have noted rule 1118(2) and will proceed.

Rule 871(1) (d) was read and Mr Lamas admitted the breach.

Mr Sanders demonstrated on the films available of the home straight with a round to go, RICH REWARD was tightened by the inwards movement of BEAU PRINCE.  Mr Lamas does endeavour to correct but by then it was too late.  Mr Lamas was not clear and Mr Parkes was checked and no other horses were affected.

Mr Lamas stated he has put a bit of pressure on Mr Parkes but had attempted to relieve that pressure but the horse has not come off as quick as he had liked.
The committee find the charge proven.

Penalty
Mr Neal could find no breach of this rule in the past 12 months by Mr Lamas, he is a “national“ rider and a request for a term of suspension for a mid range offence of 4 days was made. 
Apprentice B Lamas asked the committee to consider his future commitments.

Decision
The committee have carefully considered all the evidence presented and start at a 4 day penalty request and take into account;
1  Apprentice Jockey  B Lamas did admit the breach.
2  His excellent riding record.
3  The degree of carelessness at mid range.
4  That one horse was affected.

The committee support a term of suspension to begin at the close of racing on the 15th March up to and including 20th March 2009 (3days).
