Accordingly the protest was dismissed and placings allowed to stand as called by the Judge.

Dividends were directed to be paid accordingly.

Facts:

Following Race 2, The Whangaehu O’Learys 1600, a protest was lodged pursuant to Rule 642(1) by Mr T Harris alleging that horse number 10 (REEPERBAHN) or its rider placed 1st by the Judge interfered with the chances of horse number 5 (TAIPA TIGER) placed 2nd by the JUDGE.

The official margin between 1st and 2nd was a nose.

Submissions for Decision:

Mr Harris lodged the protest and began by showing the head-on view of the final stages of the race. He told the committee that at the 50m mark he received a knock from REEBERBAHN (Shaun Fannin) when that horse made contact from his outside. He played the film a number of times from front, side and rear views which showed REEBERBAHN drifting inwards several horse-widths. Mr Harris said the contact resulted in a loss of momentum to his horse and taking into consideration the nose margin at the finish he believed this cost him the race. He added that he would not have lodged a protest if the margin had been greater than a nose.

Mr Rennie, on behalf of Ms Latta, said the contact which occurred just short of the post caused TAIPA TIGER’S hindquarters to be turned inwards definitely affecting its chances of winning the race.

Mr Myers played the films again, pausing them at several stages to identify the relative positions of both runners. He said this clearly showed that TAIPA TIGER contributed to the interference by moving outwards as much as REEPERBAHN moved inwards indicating both horses were to blame. Mr Myers also asked the committee to take note that at no stage did Mr Harris have to stop riding.

Mr Fannin did not wish to comment.

For the Stewards Mr Ydgren said both horses moved off their respective lines of running and despite the contact and Mr Harris having to alter his riding style he did not believe the interference affected the result of the race.

Reasons for Decision:

In coming to a decision the committee carefully considered all of the evidence presented. After viewing all the available films several times we were satisfied that both horses did drift off a direct line of running and make brief contact. REEPERBAHN moved inwards from wide on the track and TAIPA TIGER drifted outwards albeit to a lesser degree. Nonetheless both horses contributed to the resultant interference which in our opinion was reasonably minor. Both riders were able to continue riding out to the line.
