Charge:

Following race 5 an information was lodged under rule 869 (2) (a) in that J P Stormont the driver of Ten Guitars used his whip excessively on his horse over the concluding stages.

Rule 869(2) (a) reads;
No horseman shall during any race;(a) use his whip in an unnecessary, excessive or improper manner.

Facts:

Mr Taumanu informed the committee due to travel arrangements and the delay to the day’s proceedings, with racing starting 30 minutes later than the advertised time, that Mr Stormont would be unable to attend this hearing.

The hearing then proceeded with Mr Taumanu using the head on video film to show the committee where in the home straight Mr Stormont used his whip over the concluding stages of the race, in an excessive manner to the line. There was a pause or stop for two or three strides, where the whip was not used, halfway through the incident.

Mr Taumanu informed the committee that Mr Stormont asked that the committee be aware that he had seen the film and confirmed he was at fault.

Submissions for Penalty:

Mr Taumanu stated Mr Stormont has not been before the stewards under this rule and as a first offender he has an excellent record and has admitted the breach. The stewards asked for a penalty in the region of $200-$250.

Reasons for Penalty:

The committee in reaching their decision have taken into account all evidence presented. Mitigating circumstances for Mr Stormont were his early admission of the matter, and that this is his first offence. The committee have noted that this was not a situation of continual striking with the whip, although outside the guidelines, there was a break of several strides during the incident. The committee therefore imposes a monetary penalty.
