The Starter, Mr. P. Phillips, loaded Farun (R. Hannam) and Classic Dale (H. Tinsley) from the wrong barrier stall.



The Starter,  Mr. P. Phillips, loaded Farun (R. Hannam) and Classic Dale (H. Tinsley) into the wrong barrier stalls.

 Mr. N. Goodwin informed the committee the horses were loaded into the wrong stalls and raced from the wrong stalls.  The horses were being lead around and on being called up moved into the stalls.  Mr. Phillips agreed that staff numbers at the start were adequate.

 Mr. Goodwin in speaking to the two jockeys concerned, confirmed they were lead up into the wrong stalls.

 Mr. Phillips informed the committee that he had been starting at Wairoa for 20 years.  He lives in Australia but doesn?t do any starting there.  This is the only course at which he is the official starter, and receives payment.  He allows three minutes to load and calls both the number and the jockeys name when loading.  The jockeys were talking and may not have heard him but he did state that he would have thought two senior jockey would have known they were being lead up into the wrong stall.  Neither jockey called out.

 The clerk of the courses horse shied just about the time the horses were to enter the stalls and he did take his eye off the barriers for a second or two.  He concurred with Mr. Goodwin that it was his responsibility as starter to ensure that horses do start from the correct stalls.  Mr. Goodwin informed the committee that although the breach of the rule was unusual he believed it was a serious breach and asked for a monetary penalty of $400.00.

Mr. Phillips, this committee is also of the opinion this is a most unusual breach of the rules.  One that we don?t believe has happened before.  However, the breach is serious, horses are drawn their stalls, and race tactics are determined from their barrier draw.  The two horses concerned clearly raced from the wrong stalls.  We were a little surprised that the two senior jockeys concerned, m/s Tinsley and Hannam did not realise they were being lead up to the wrong stalls and we also concur with you that the clerk of the course's horse shying may have been a distraction.  We have also taken into account your statement to us that this is the only course at which you are the official race starter and that you have been coming here for 20 years.  However, it must be recognised that this is a serious breach of the rule, it is purely conjective if starting from the wrong stall effected the running of that race.  Mr. Phillips, the committee, being mindful of your admittance of the breach, your acceptance that the responsibility to ensure correct loading was yours, has decided to fine you the sum of $450.
