Facts:

Following the running of race five at Wairoa The Kenilworth Plumbing Distance Maiden Miss D Hirini admitted a breach of 638 (1) (d). The rule reads:

' A rider shall not ride a horse in a manner the judicial committee considers to be careless'.

It is alleged she permitted her mount CHOP SUEY to shift inwards when not sufficiently clear of AMUN RA which was checked near the 1400 metres. The rule was read and the available films shown by Mr J Oatham. He pointed out the gradual inward movement of Miss Hirini's mount causing the rider of AMUN RA (D Nolan) to take hold and was checked.

Submissions for Penalty:

Mr Harrison, on Miss Hirini's behalf, told the committee that she had only been riding a few months. She was a promising rider and had never appeared before a committee. This could be classed as part of her learning curve. Miss Hirini had little to add except to say she came across too quickly. Mr Tidmarsh asked for a penalty to reflect the low degree of carelessness and the fact it was her first offence.

Reasons for Penalty:

The committee agreed that the degree of carelessness was low. The breach was admitted and this was her first offence.
