Facts:
Prior to the running of Race 6 (Wairoa Business Supporters Cup Trial 1900m) Information A11627 was filed with the Judicial Committee. It alleged a breach of Rule 330(3)(c) by jockey Cameron Lammas specifically alleging that he “...was unable to make the contracted weight for HATTIE BEE (54kg) in Race 6.” Mr Lammas confirmed that he understood the rule and admitted the breach.
Stipendiary Steward Darin Balcombe advised the Committee that as soon as Mr Lammas had arrived on course he had advised Stewards that he was unable to make the weight of 54kg in Race 6. He was immediately replaced with a “like for like” rider in Ms S Collett and that HATTIE BEE’s connections were comfortable with the replacement rider.
Mr Lammas confirmed to the Committee that he was 1 kg over and explained that he had sweated the night prior and again at 3am on race day. He had also wasted in order to make a 53kg riding commitment the week prior, but that on this occasion his body had found it difficult and that it was harder to get the weight off.
Submissions for Penalty:
Mr Balcombe confirmed that the current breach was Mr Lammas’ third breach within the previous 120 days. His most recent breach was on the 15th February at Auckland ($200) with the breach before that being on the 26th December at Auckland ($100). He submitted a fine as appropriate.
Mr Lammas had no submissions to make on penalty.
Reasons for Penalty:
The Committee considered the submissions placed before it. As this is Mr Lammas' third breach within a previous 120 day period it falls outside of the Minor Infringement Scheme and has been referred to the Judicial Committee.Whilst he had taken some actions to try and make 54kgs, he was unable to fulfill his responsibilities as an engaged rider. It is fortunate that a suitable replacement in Ms Collett could be engaged and that connections were fine with that. We consider an uplift from the previous penalty of $200 as appropriate.
