Following the running of Race 7, The Sunset Point Sports Bar and Bistro 1850, the siren sounded instigating a protest.

--

The protest alleged that the provisional winner Quin Tait interfered with the chances of Cantgetenough, provisionally placed second by the judge, the interference happening in the home straight.  The margin between the horses was a head.

The protest alleged that the provisional winner Quin Tait interfered with the chances of Cantgetenough, provisionally placed second by the judge, the interference happening in the home straight.  The margin between the horses was a head.

The provisional placings as called by the judge were:-
 
 1st Quin Tait
 2nd Cantgetenough
 3rd Mr Thorpedo
 4th Casual Joy
 5th Postmaster Bay

Rule 642 (1) – if a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse and the Judicial Committee is of the opinion that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

Using the available films trainer P Hurdle of the 2nd placed horse Cantgetenough informed the committee that approximately 200 metres from the finish his horse was interfered with when the 1st placed horse Quin Tait moved inward and took the line of his horse when it was making its run.  He believed his horse lost momentum and although he conceded that jockey Dalley did relieve immediately the damage had been done and his horse was unable to take advantage of the gap that was presented prior to the incident.

Miss K Myers concurred with the statements made by Mr Hurdle and told the committee that Cantgetenough was a big striding horse who after having its line taken lost momentum and was coming back in the run to the line.

--

Trainer J Morell told the committee that his horse was travelling – yes it did move inwards.  He felt that at no stage did Miss Myers stop riding and that after his jockey immediately corrected there was ample room for Cantgetenough to mount its run.  He believed very little if any momentum was lost.

Jockey E Dalley told the committee that his mount did move inwards, any contact was minimal and he corrected immediately.  He reminded the committee that the incident happened at the 200 metre mark and felt that if Cantgetenough was good enough it would have won.

--

Stipendiary Steward N Goodwin, under the rules of racing, was asked to comment.  He concurred that Quin Tait did move inwards and onto the line of Cantgetenough, however he felt the movement was minimal and although both horses came together he felt the actions of Jockey Dalley in relieving immediately gave Cantgetenough every chance with the gap that was presented to pick the winner up.

Decision and Reasons:-

--

In coming to our decision we have carefully considered the evidence from all the parties concerned and revisiting the available films.

--

There is no doubt that at the 200 metre mark Quin Tait did move inwards and onto the line of Cantgetenough.  We believe that at that point Quin Tait was approximately a neck in from of Cantgetenough.

--

Jockey E Dalley did correct immediately and although we believe slight contact was made at that point we do not believe that Miss Myers took hold of her mount or stopped riding.

--

Upon correction a widening gap was presented to Cantgetenough to mount its run and we are of the opinion that the horse had every opportunity in the run to the line.  We were mindful that the official margin at the line was a head.

--

Placings were allowed to stand and payout on the judges call authorised.
