Facts:
Miss R. Myers admitted a breach of Rule 638 (1) (d). She confirmed that although entitled to representation being an apprentice, she was happy to represent herself at the hearing.
Submissions for Penalty:
Mr. Goodwin using the available films pointed out the incident in which Miss Myers allowed her mount ‘Sheshalljaz’ to shift in after the start when not clear of ‘Cachucha’ (K. Myers), ‘Mirai’ (C. Parish) and ‘Total Confusion’ (R. Hannam) which were all buffered for some distance.
He informed the committee that although no inference occurred, buffeting did occur and the horse most affected was the mount of Mr. C. Parish.
Mr. Goodwin indicated the degree of carelessness was in the mid range, he felt it was an error of judgement.
Miss Myer’s record under this rule was produced and Mr. Goodwin told the committee Miss Myers was last suspended at Gisborne on the 5th of November 2010. Previous to that he had to go back to the 1st of April 2010 when she was suspended for 5 days.
Mr. Goodwin told the committee that Miss Myers had had 391 rides since she was last suspended. He confirmed she was a national rider and asked for a period of suspension of 4 days.
Miss Myers told the committee that she was intent to get to the lead and in her words ‘I cut it fine’. She asked the committee to take into account that only buffeting resulted from her actions and that in the event of a period of suspension being imposed asked for it to begin after this Saturday’s premier meeting at New Plymouth.
Reasons for Penalty:
Miss Myers, in coming to our decision to impose a period of suspension for this offence we have taken into account your admittance of the breach and your record under this rule which is very good. We concur with the stewards that it sits in the mid range of degree of carelessness.
This committee has started from a base of 5 days and have decided to reduce by 1 day your suspension for the reasons outlined. Any consideration of a further reduction we believe could not be accommodated because of the relatively strong buffeting your actions caused to the horses on your inside, particularly Mr. Parish’s mount.
