Decision:

We accordingly advised the Stipendiary Stewards that in our opinion GEORGIE SIVAD was not denied a fair start.

Facts:

Mr Williamson, the driver of GEORGIE SIVAD, sought a ruling pursuant to r 213(1)(j) as to whether that horse was denied a fair start in race 10 the RYAL BUSH TRANSPORT LTD MOBILE PACE.

Submissions for Decision:

Mr Williamson demonstrated on the videos that prior to the start GEORGIE SIVAD was being led by a Starter’s Assistant. He stated the trainer had specifically asked the Starter that an Assistant walk the horse around. The horse was behaving itself at this time. The horse was being led by an Assistant and was walking in a small circle. The Assistant let go of the horse or lost his grip on the bridle. The horse was fine for a short time before playing up. The Starter’s Assistant was unable to regain his hold on the horse. At this time the mobile began to move away and GEORGIE SIVAD lost a considerable distance before starting well behind the field.

Mr Williamson alleged the Starter’s Assistant was at fault as he had not done what he was told and thus the horse had not obtained a fair start.

Mr Walkinshaw confirmed it was important to get the horse rolling and it would be okay at the start. He too said the problem was that the Starter’s Assistant had let go of the horse. As a result the horse had lost momentum and then played up. It had failed to score up with the rest of the field as a consequence.

Mr Renault stated the horse had failed to get away because of its manners. He agreed the horse had been walking around okay but after the Starter’s Assistant let go of the horse it had backed away and refused to go away. He had no knowledge of any discussion between the trainer and the Starter’s Assistant. He said he did not believe the Starter’s Assistant was at fault.

Reasons for Decision:

We are satisfied that GEORGIE SIVAD was slow away due to its manners at the start. It is correct to say that the horse was walking satisfactorily when being circled by the Starter’s Assistant. However, when he lets go of the horse in order for it move forward with the rest of the field, GEORGIE SIVAD backs away and then refuses to go. It is drawing too long a bow to blame the Starter’s Assistant in these circumstances. He was no longer holding the bridle of GEORGIE SIVAD. The horse failed to move away with the field of its own accord.
