DECISION AND REASON:
--At the conclusion of Race 10, an information was lodged by Stipendiary Steward Mr CJ Allison, alleging that Mr J Hackett (COPPER BELT) shifted inwards moving FLYIN CULLEN (KL Barclay) onto THE LOUT (E Swain) causing THE LOUT to break, checking DYNAMIC ATOM (R Barclay) after the start.
--Mr Allison used several video clips of the alleged incident, highlighting, in his opinion, the movement inwards by COPPER BELT, when not sufficiently clear. Mr Allison also stated that Mr Hackett had made no effort to attempt to react to his initial poor judgement.
--Mr Hackett having admitted the breach, re-iterated that he had made a poor decision, and regretted his actions.
--In fixing penalty it was noted that Mr Hackett was a junior horseman, who had only eight raceday drives. Mr Hackett had no offences under this rule in a very limited driving career.
--Mr Hackett was suspended up to and after the conclusion of racing on Sunday 29 October 2006.
