Following Race 5 an information was lodged by Stipendiary Steward Mr C J Allison alleging that Mr A W Kyle, driver of SMART OPERATOR, used his whip excessively over the final stages.

DECISION REASON & PENALTY :
--Following Race 5 an information was lodged by Stipendiary Steward Mr C J Allison alleging that Mr A W Kyle, driver of SMART OPERATOR, used his whip excessively over the final stages.
--Mr Allison said that Mr Kyle used his whip continuously in excess of 25 strokes with no distinct pauses from just after the 400m till about 50 metres from the line. He concurred with Mr Kyle's assertion that he had backed off from about the 50 metre mark.
--The guidelines say that "excessively" is too much in relation to normal and that no horse may be hit continuously at any part of the race, without clear pauses.
--Video evidence confirmed the evidence given verbally. I find the charge proven.
--Submissions as to penalty were heard and Mr Allison said this was a mid range offence and would call for a fine of about $250. Mr Kyle said he would prefer a fine as he enjoyed driving his horses.
--Giving credit for the fact that Mr Kyle stopped hitting when he considered he had no chance, but taking into account that this was definitely excessive use of the whip, I fine Mr Kyle $250.
