Facts:
Following the running of race 4 the Otautau Vets Ltd Mobile Trot Stewards lodged a Protest under r870 (5) against the first placed KIWITRIX. The information alleged that KIWITRIX broke from its gait short of the finish line and was lapped on by CHRISTMAS BABE at the finish. Mr Williamson represented the connections of KIWITRIX and did not contest the Protest.

Mr Munro, with the use of the videos, stated that about 40m from the finish, KIWITRIX, which was leading, started to trot roughly and eventually broke from its gait approximately 10 metres from the finish. KIWITRIX continued on in a gallop and was lapped on by CHRISTMAS BABE at the finish line. The official margin was a ½ length. He sought the relegation of KIWITRIX under r 870 (5), to 2nd placing.
Reasons for Decision:
The Protest was not contested and we are satisfied that KIWITRIX was in a break at the finish line and was lapped on by CHRISTMAS BABE.
