Mr Hay was charged with a breach of r 869(2), in that he used his whip more than permitted under the Use of the Whip Regulations, when driving YOSSI in race 2.
Mr Munro, with the use of the videos, stated YOSSI was outside the leader on the home turn. He said Mr Hay drove his horse out to the finish, but in doing so was observed to strike his horse 12 times from that point to just prior to the finish line. He said Mr Hay used his whip in excess of the allowable limit.
Mr Hay said he had misjudged the number of times he had used the whip.
