Decision: Information 67426 was lodged by Stipendiary Steward Mr N McIntyre under rule 869(3)(b) alleging that junior horseman B Munro drove carelessly by allowing his horse CARDINAL HUFF  to strike the wheel of JADE BROMAC driven by junior horseman A Sanderson causing the sulky tyre on JADE BROMAC to come adrift.

Information 67426 was lodged by Stipendiary Steward Mr N McIntyre under rule 869(3)(b) alleging that junior horseman B Munro drove carelessly by allowing his horse CARDINAL HUFF  to strike the wheel of JADE BROMAC driven by junior horseman A Sanderson causing the sulky tyre on JADE BROMAC to come adrift.

Mr Munro, who was assisted by senior horseman C Thornley, admitted the breach.

Rule 869 (3)(b) states: “No horseman in any race shall drive carelessly”.

Stipendiary Steward Mr McIntyre, Mr Munro and Mr Thornley all agreed that all of the statements made from the protest hearing (Information 14057) were accurate and no further evidence or statements were required. The breach of the rule was therefore upheld.

Submissions on Penalty

--

Mr McIntyre stated Mr Munro was a junior horseman and was having only his second race day drive.  He suggested a range of penalty between $250 to $300.

Mr Thornley stated that Mr Munro was a stablehand earning at a low level and asked the Committee that they consider a suspension.

Decision

--

The committee in fixing penalty took into account Mr Munro’s early admittance of the breach and also Mr Thornley’s request.  Mr Munro was suspended to the conclusion of racing on Monday 26 October 2009.
