The protest was upheld and the official judges placings were amended to read:

   First 6 Forrest Bobo

   Second 7 Buster Balou

   Third 8 Dyed Blonde

   Fourth 11 Itsnewstome

   Fifth 12 Running under fire

Verasprideandglory was disqualified to 14th placing.

Facts:

Following the running of race 8 the Winton Night 'n' Day Foodstore/Drummond Home Kill Mobile Pace a protest was lodged by Stipendiary Steward Mr N. M. Ydgren alleging that the second placed horse by the judge Verasprideandglory (C. Barron) had caused interference to Natural Grin (B Munro) with approximitly 500 metres to run.

Mr Barron confirmed he understood the rule and the basis of the protest.

The judges placings were:

   First 6 Forrest Bobo (A Beck)

   Second 10 verasprideandglory (C Barron)

   Third 7 Buster Balou (J Cox)

   Fourth 8 Dyed Blonde (D Dunn)

   Fifth 11 Itsnewstome (P Hunter)

   Sixth 12 Running under fire (B Barclay)

Mr Ydgren showed the committee video clips of the race with approximitly 500metres to run.  He pointed out where Mr Barron's horse Verasprideandglory was four back on the fence and over racing.  Mr Barron's horse then 'Got up on the wheel' of Mr Munro's horse causing the wheel to puncture.  Mr Ydgren stated that it was his belief that Mr Barron (Driver) did not contribute in any way to the incident,but the chances/progress of Mr Munro's horse Natural Grin was effected.

Mr Barron gave evidence that his horse was over racing and that he made every attempt to keep his horse 'Dead Plumb' he also stated that he waited a significant amount of time to get out from the rail position.  Mr Barron also stated that the false start, and the hard early pace had put his horse on edge.  Mr Barron stated that he immediatly had appoligised to Mr Munro and had reported the incident to the Stewards on his return to the Birdcage.  Mr Barron also confirmed to the committee that his horse had caused the interference to Natural Grin.

Mr Gameson (Trainer of Natural Grin) stated that he also owned the horse and that from three back on the rails it had alot of work to do and he was unsure whether it would've been able to run a place.

Mr Munro stated that his horse Natural Grin was in his opinion travelling well prior to the incident, that he had not pulled the hood and that when the tube and tyre became entangled with the wheel he pulled his horse up.

Submissions for Decision:

Mr Ydgren contended that Mr Barron's horse had clearly caused the interference and that Natural Grin had had his chances severly affected.

Mr Barron submitted that his horse was severely over racing and he did all he could to avert the situation. 

Reasons for Decision:

The Committee was satisfied that Natural Grins chances were severely affected by Verasprideandglory which was over racing and caused Natural Grins wheel to puncture when striking it.
