The breach of rule 862(2) was found proved.

Penalty:

Mr Beck was fined the sum of $350.00 and reminded of his professional obligations.

Charge:

No Horseman shall permit a horse to start other than from it's correct barrier position (either at a standing or mobile start), unless directed by the starter in accordance with rule 860(8).

Facts:

Following the running of Race 1 The Goodman Plumbing/Workouts Committee Mobile Trot an information was filed by Stipendiary Steward Mr S. Renault alleging a breach of rule 862(2) by Mr A R Beck (Regal Image).

The information reads "you permitted your horse 'Regal Image' to start from barrier four on the second line when you had drawn third on the unruly list.

Submissions for Decision:

Mr Renault gave evidence and used the video clips to highlight how Regal Image (AR Beck) started effectively between barrier three and four.

He also stated that Mr Beck should have started his horse from barrier position seven, and that if, under the rule, Regal Image had run in a stake bearing place the horse would have been disqualified.

Mr Beck having admitted the charge said that he had made an error and did not realise that the horse was starting in the unruly position.

He also stated that he had driven the horse previously in its most recent start which was a standing one not on the unruly list.

Reasons for Decision:

The Committee was satisfied that a clear breach of the rule had occurred and that Regal Image (AR Beck) had started in the incorrect barrier position.

Submissions for Penalty:

Mr Renault stated that Mr Beck had driven in six thousand six hundred and sixty one races and had two hundred and thirty five drives last season and twenty three drives in the current season.

Mr Renault said that Mr Beck was extremely experienced driver but on this occasion his action was well below what is expected from a professional horseman.

Mr Beck had no previous charges under this rule in the previous twelve months.

Mr Beck said that he had been confused and had simply an oversight on his behalf on this occasion. He told the Committee that the horse did not cause any interference to any other horse and that his horse did not finish in a stake bearing place.

The Committee considered all of the evidence and agreed that on this occasion Mr Beck had made a serious error of judgement and that clearly his horse (Regal Image) had started in the incorrect position.

Mr Beck was a very experienced senior horseman and his actions fell well short of what could be expected of someone of his experience.
