FACTS:

--

Mr Davidson alleged a breach of R 638(1)(d) in that Mr Stackhouse, the rider of NO ONE, permitted his mount to shift in and caused THRILLER to be checked. This happened near the 50 metre mark.

Mr McLaughlin demonstrated the incident on the videos. This showed Mr Stackhouse’s mount NO ONE moving in and being corrected by him. However, after he had straightened the horse, and some 50 metres from the winning post, he hit the horse with the whip and the horse again shifted in crowding Mr Laking who had to briefly stop riding. Mr Davidson stated Mr Stackhouse’s carelessness lay in his using the whip in these circumstances. Mr Stackhouse and Mr Hamilton agreed with this description of the breach.

Mr Stackhouse admitted the charge, which we thus find proved.

SUBMISSION(s) AS TO PENALTY:

Mr Davidson described the breach as being low end. He produced Mr Stackhouse’s record, which showed one breach of this rule in January this year when a 2 day suspension was imposed. Mr Davidson stated Mr Stackhouse was a national rider and submitted a four or five day suspension was appropriate.

REASON(s):

--

We agree with Mr Davidson that this breach is at the low end of seriousness. Mr Stackhouse did initially take corrective action. Mr Laking had to stop riding for only a stride and it is not possible on the evidence to draw any conclusion as to whether it cost him a better placing.

Mr Stackhouse’s record was correctly described by Mr Davidson as being very good. Mr Stackhouse has also readily admitted the breach. We believe a 4 day suspension is sufficient to hold him accountable.

DECISION:

--

Mr Stackhouse, through his employer, Ms P Gerard, has requested that the commencement of the suspension be deferred until after racing at Wingatui on Thursday 20 May.  Mr Davidson does not object to this deferral.  Mr Stackhouse is suspended from the end of racing 20 May to and including Wednesday 26 May.  He is reminded of his obligations to fellow jockeys when riding a horse out at the finish of the race.
