As Miss Barnes admitted the breach the Committee find the charge proved.

Penalty:

Miss Barnes had her licence to ride in races suspended for a period to commence after racing on Sunday 15th May 2016 and concluding after racing on Sunday 22nd May 2016 (2 days).

The meetings being the South Canterbury Jockey Club 19/05/16, and Riverton Racing Club 22/05/16.

Facts:

Following the running of race 3 the Travellers Rest Tavern and Farmlands Maiden, an information was filed pursuant to 638(1)(d). The informant Mr Tidmarsh alleged that Miss Barnes allowed her mount KONA to shift outwards dictating ODI ET AMO onto the heels of RISKY FLIGHT (J Lowry) resulting in ODI ET AMO (J Morris) clipping a heel and blundering past the 350 metre point.

Miss Barnes acknowledged that she understood the rule and confirmed her admission of the breach.

Rule 638(1)(d) provides:

A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr McLaughlin demonstrated the incident on the available video footage. He identified that near the 350 metre mark, Miss Barnes has moved her horse KONA when racing three back on the inside running rail, shifting outwards when not sufficiently clear resulting in ODI ET AMO (J Morris) clipping a heel.

Miss Barnes admitted she had made an error of judgement, but thought there may have been some movement inwards from the horses racing on her outside, in particular MIDNIGHT LATTE (R Hannam).

Submissions for Penalty:

Mr Tidmarsh produced Miss Barnes' record which showed no previous breaches under this rule in the last 12 months. He described the level of carelessness to be at the lower end of the scale.

Mr Tidmarsh also stated that Miss Barnes was a very busy rider, having had 287 rides this season.

Mr Tidmarsh recommended a 2 day suspension may be appropriate in this instance.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

The Committee have adopted 3 riding days as the starting point in considering the term of suspension for the careless riding charge.

The mitigating factors were Miss Barnes' admission of the breach and her outstanding riding record in relation to this rule for which she has been given credit.

We assess the level of carelessness to be low.

After taking into account all of the above factors the Committee considered an appropriate suspension was 2 days.
