Facts:
Following the running of Race 8 The McConachie Shearing Ltd Wairio Plate an information was filed pursuant to rule 638(1)(d) by Co-chief Stipendiary Steward Mr R L Neal against apprentice jockey Miss C Barnes, alleging that Miss Barnes permitted her mount Tommy Tucker to shift in near the 800 metres when not clear of Commanche Gold (R Cuneen) which was checked.
Miss Barnes was present at the hearing, and was supported by Mr W Harnett who is the Apprentice Jockey Mentor.
Miss Barnes confirmed she understood the rule and also confirmed she admitted the breach.
The rule reads 638(1)(d):
(1) A rider shall not ride a horse in a manner which the Judicial Committee consider to be:
(d) careless
Mr Neal, had Co-chief Stipendiary Steward Mr N McIntyre show video replays of the incident with approximately 800 metres to run. He pointed out the runners concerned. He alleged that Tommy Tucker was improving at this point and had moved across in front of Commanche Gold when not sufficiently clear, perhaps “less than a length” causing that horse to be tightened and checked.
Mr Cuneen had to take a hold of his horse, which was racing keenly at the point of the check.
Mr Neal said that the stewards believed Miss Barnes had reacted too slowly to prevent the incident.
Miss Barnes said she had made an error of judgement. She thought Mr Cuneen would take a hold of his horse which did not eventuate, as his horse was also racing keenly.
Submissions for Penalty:
Mr Neal said that Miss Barnes had an excellent record with no breaches under this rule in the past 12 months (there was no record on hand of Miss Barnes' number of rides, either for last season or the current season).
Mr Neal submitted that Miss Barnes was a busy lower South Island rider having on average about 5 rides per meeting. He also said that the stewards believed the breach was at the mid to low end of carelessness.
Mr Neal referred to the JCA Penalty Guide which had a starting point of a 3 day suspension, for a South Island rider. He also made mention of Miss Barnes' admission of the breach. He submitted that a penalty of not less than a 2 day suspension was appropriate.
Miss Barnes submitted that she was a busy rider, with 8 rides at today’s meeting and that she had a very good riding record.

The JCA penalty guide suggests a 3 day suspension as a starting point. There were no aggravating factors to lift the penalty, as the breach was at the mid to low end of carelessness.
There were several mitigating factors to consider. Miss Barnes had an excellent race riding record and had admitted the breach at the earliest possible point, and as a result Miss Barnes was entitled to a 1 day discount.
