Decision:

The Committee has decided to exercise its discretion and declares “Eternity” to be a non-starter. Authorisation is given to the payment of amended dividends.

Facts:

Following the running of Race 7, the Listed “WRC/Pope and Gray Contractors Wairarapa Thoroughbred Breeders’ Stakes” Information A7651 was filed by Stipendiary Steward Mr N Goodwin seeking a request for a ruling under Rule 632. The Information said “that “Eternity was denied a fair start”.

Rule 632 states “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter”.

Submissions for Decision:

Mr Goodwin used the head-on film of the start of the race to highlight “Eternity” who was drawn in barrier 12 in the 13 horse field. He said the film showed “Eternity” charge the gate, rear up and get its head over gate which was also slow to open.

Mr Goodwin asked the starter Mr Phillips to say what he believed happened at the start. Mr Phillips said from his position he believed “Eternity” had charged the gate just as he released the horses.

Mr Turner, the rider of “Eternity”, said that as the starter was half way through his call prior to releasing the gates “Eternity” lunged at the gate and got its head over it as they opened. He then said film clearly showed the left hand side of the gate rebounding into the head of “Eternity” as the horse left the barrier.

The Trainer of “Eternity” Mr Gray had no comments to add.

Mr Goodwin said it was the submission of the Stewards that “Eternity” be declared a non-starter.

Reasons for Decision:

The Committee carefully considered the films of the start and submissions of all parties. The Committee is satisfied “Eternity” was denied a fair start. Whilst its actions in rearing and hitting the gate may have caused the gate to be slightly slow on opening the film clearly shows the horse being struck on the left side of its head when the front left part of the gate rebounded back into Eternity” after opening. The Committee notes that “Eternity” ran last in the race.
