The Committee has decided to exercise its discretion and rules that “Somethingvain”, “Moccona Mist”, “The Auld Floozie” and “Savaria are all declared non-starters. For completeness this means that a total of 5 horses are declared non-starters in the race.
The confirmed result is now:-

5th “Tie Me Down” (7)
Authorisation is given to the payment of amended dividends and stakes.
Facts:
Following the running of Race 7, the Listed “WRC/Pope and Gray Contractors Wairarapa Thoroughbred Breeders’ Stakes” Information A7652 was filed by Stipendiary Steward Mr N Goodwin seeking a request for a ruling under Rule 632. The Information said “that “Somethingvain”, “Moccona Mist”, “The Auld Floozie” and “Savaria” were denied fair starts”.
Rule 632 states “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter”.
Submissions for Decision:
Mr Goodwin used the head-on film to show the start of the race. He played the film frame by frame and said the film clearly showed that the following horses were affected by their gates opening slowly:-
1 “Savaria” drawn 10
2 “Rohaise” drawn 7
3 “Somethingvain” drawn 13
4 “The Auld Floozie” drawn 11
6 “Eternity” drawn 12
8 “Moccana Mist” drawn 14
9 “Mae West” drawn 6
He said that “Rohaise” and “Mae West” were not included in the Information as they had run second and third respectively in the race. Mr Goodwin asked the riders of the affected horses for their views on what happened at the start.
Ms Spratt (“Somethingvain”) felt her gate was slow to open which had meant that her horse, who is usually a front runner, could not get to that position. She asked the Committee to note that she had run second to last in the race.
Ms Johnson (“The Auld Floozie”) said she made a tardy beginning because her gate was slightly slow on opening.
Mr McNab (“Savaria”) said he could not say if his gate was slow to open but did say his horse got a fright when “Eternity”, which was two stalls to his outside, reared as the gates opened.
Ms Myers (“Moccona Mist”) said she wasn’t sure if her gate was slow to open.
Messrs Bergerson, Marsh and Lock and the representative from the Rogers stable all agreed that their horses’ gates opened slowly.
Mr Goodwin said it was the submission of the Stewards that “Somethingvain”, “Moccona Mist”, “The Auld Floozie” and “Savaria all be declared non-starters.
Reasons for Decision:
The Committee has carefully considered the head on film of the start and submissions of all parties. The Committee is satisfied that gates 6, 7, 10, 11, 12, 13 and 14 were slow to open. “Rohaise” which was drawn 7 finished second and “Mae West” which was drawn 6 finished third in the race. Those two horses are therefore not included in the request for a ruling as they finished in the first three placings. “Eternity” which was drawn 12 was the subject of a separate request for a ruling – Information A7651.
The Committee believes it is clear the 4 horses included in the Information were prevented from taking an effective part in a Race by being denied a fair start and such occurrence materially prejudiced the chances of those horses.
