Facts:
Following the running of R6, (NZB Insurance Pearl Series Race) Information No. A7667 was filed with the Judicial Committee. It alleged that Ms Moki, the rider of the 5th placed horse KATIEM MARIE failed to weigh in.
Ms Moki acknowledged that she understood the rule and confirmed that she admitted the breach.
Rule 647(1) provides:
All riders in a race shall weigh-in, unless excused from doing so by a Stipendiary Steward. A horse whose rider does not weigh-in shall, in addition to any other penalty which may be imposed, be disqualified from the race unless the Stipendiary Stewards are satisfied that the:
(a) Riders failure to weigh-in in accordance with this rule, was justified by extraordinary circumstances, including if the Stipendiary Stewards are satisfied that, on account of accident or sudden illness, it is impracticable for him to weigh-in and
(b) Rider weighed out correctly with, and carried, his proper weight.
Mr Goodwin said that following the running of race 6, Miss Moki the rider of KATIEM MARIE did not weigh in. He said that Ms Moki walked straight past the scales and into the jockeys room. He added that the horse finished in 5th position which had a $300 prize.
In answer to a question from the committee, Mr Goodwin said that the horse had already been disqualified by the Stipendiary Stewards. The riding fee was also forfeited.
Mr Hannam, on behalf of Ms Moki, said that the weigh in area had been crowded most of the day and that he himself on two occasions had had to wait a couple of minutes to weigh in due to the congestion in and around the weighing room. He added that this did not help with your concentration. He concluded by saying that he was not excusing Ms Moki from not weighing in but understood how it could have happened.
Ms Moki said that she was distracted when talking to a stable representative on the way to the weighing room. She confirmed that she went straight to the jockeys room and did not weigh in.

Mr Goodwin said that Ms Moki had a clear record under the Rule and submitted that a fine be imposed.
Mr Hannam and Ms Moki were advised by the Committee that the JCA starting point for such a breach was $300 and were invited to comment. Neither had any further comment.
Reasons for Penalty:
When considering penalty, the committee took into account the submissions of all parties, the admission of the breach, that this was the first time Ms Moki had breached the rule, and the JCA starting point of a fine of $300.
