As the charge was admitted, the question of penalty was then addressed.
Penalty:
Mr. Collett, you are suspended from race riding after the completion of racing on Saturday the 12th of February until the completion of racing on Friday the 18th of February (4 national days).

Facts:
Mr. J. Collett admitted a breach of Rule 638 (1) (d) in that passing the 250 metre mark he permitted his mount ‘She’s Prestigious’ to shift out when not clear causing checks to The Music (L. Allpress) and Howbadami (D. Walker). Mr. Collett was represented by senior jockey and stable representative Mr. A. Peard.
Mr. N. Goodwin, using the available films, informed the committee that Mr. Collett moved approximately 4 – 5 horse widths outwards at the 250 metre mark causing checks to two horses. Both the horses affected had come to the end of their runs and were not involved in win and place dividend bearing positions. However the checks were of a degree that both riders had to take hold. He informed the committee that Mr. Collett did attempt to straighten his mount but upon drawing the whip the outward movement continued.
Mr. Collett concurred with Mr. Goodwin's comments that there was outwards movement. It was the first time his mount had raced this way around and it was travelling greenly. His mount was tending to lay out and he believed he did make serious attempts on two occasions to straighten.
Mr. Peard told the committee that while there was movement outwards the greenness of the horse was a contributing factor. In answer to a question by the Chairman he did agree that the movement was about 5 widths possibly more.
Submissions for Penalty:
Mr. Goodwin told the committee that he believed the degree of interference was in the mid range. Mr. Collett has a very good record, he has not been charged under this rule all of the present racing year, and he was classed as a national rider. Mr. Goodwin asked for a penalty of suspension reflecting the mid range of interference.
Mr. Collett asked that any suspension that would be imposed to begin after racing next Saturday. Mr. Goodwin had no objection to this request.
Reasons for Penalty:
In coming to our decision to impose a period of suspension for this breach, we have taken into account Mr. Collett your admittance of the breach and your very good riding record. We began our discussions on penalty from a starting point of 5 days and have decided to reduce by 1 day your suspension for the reasons outlined. However, we were concerned on the continuing outward movement onto the line of the two horses concerned that you allowed your mount to take. While we agree that on two occasions you did stop riding with the whip and attempt to straighten we are of the opinion that you erred in judgement by not attempting to straighten earlier.
