Following the running of Race 4, the Wilkinson Insurance Brokers (Wellington) 1300, DM Walsh the rider of GETE WAMI was charged with a breach of Rule 871(1)(d) ? Careless riding.
Following the running of Race 4, the Wilkinson Insurance Brokers (Wellington) 1300, DM Walsh the rider of GETE WAMI was charged with a breach of Rule 871(1)(d) ? Careless riding.
--It was alleged that Mr Walsh allowed GETE WAMI to move inwards when not clear of LEKKER DING (J Waddell) causing this horse to clip a heel and stumble.
--Mr Walsh, who attended the hearing, admitted the breach.
--Prior to hearing submissions on penalty the committee were shown the films of the incident. These demonstrated GETE WAMI, who was racing outside LEKKER DING, cross in front of this runner and in doing so cause him to check, clip a heel, and stumble.
--PENALTY
--When making his penalty submissions Mr Goodwin presented Mr Walsh's record which demonstrated no breaches of the careless riding rule in the time that he has been back race riding, this being some 6 months.
--Mr Goodwin submitted that the incident complained of was not of a minor nature and as such was deserving of a term of suspension.
--Mr Walsh, when making his submissions on penalty, asked that he be allowed to call jockey Waddell who he believed could assist him in regard to the magnitude of the interference. At this point Mr Walsh, in response to a question from the Chairman, reconfirmed his admission of the breach and stated that the calling of Mr Waddell solely related to a factor in mitigation of penalty.
--The committee gave Mr Walsh leave to call Mr Waddell.
--Mr Walsh, in his submissions, stated that he had moved to a position outside and in front of LEDDER DING and was taking the lead when he came down and contacted this horse. He had seen Mr Waddell restraining his horse as he moved along side and had presumed that he would not be on his inside when he moved down. Because of this he stated that he was focussing his attention on the horses on his outside.
--When called Mr Waddell confirmed that he had intended to ease to let Mr Walsh go, however as he started to do so his horse began to pull hard and he was unable to bring him back.
--Mr Walsh contended that he had relied on LEDDER DING easing and giving him clearance to cross however this had not occurred and as a result he had "cut him a fraction short". The fact that contact was made has been, in his view, an accidental rather than a deliberate act.
--Mr Walsh, in summarising his submissions, stated that he acknowledged his error however contended that due to the reluctance of LEDDER DING to respond to its rider, that on this occasion he has been a victim of circumstance and he asked that be taken into account when the committee was determining penalty.

The committee after carefully considering all submissions finds that the appropriate penalty in this case should be a term of suspension.
--The incident complained of has resulted in a runner clipping a heel and being badly checked, and in our view the matter falls toward the higher end.
--When considering the quantum to be imposed we feel that a suspension of six to seven days would not be inappropriate, however Mr Walsh has readily admitted the breach and has shown genuine remorse for what has occurred and he is given credit for this. He also has a good record and this is in his favour. We have also taken into consideration the evidence provided by Mr Waddell.
--We therefore find that Mr Walsh be suspended from the close of racing on Wednesday 8th of February up to and including racing on Saturday 18th of February. Effectively a five day suspension.
