Mr Riddell is suspended for 5 riding days from the close of racing on Saturday 5 June 2013 to the close of racing on Saturday 15 June 2013 – the 5 days being Wingatui (9 June), Waverley (10 June), Whangarei (12 June), Wanganui (13 June) and Awapuni/Ellerslie (15 June). The Timaru race day on 14 June is excluded as there are no highweight or jumping races programmed for that meeting.
Charge:
Following the running of race 4 The “G V Electrical Maiden 1300”, Information A4058 was filed by Stipendiary Steward Mr N Goodwin under rule 638(1)(d). The information stated “that over the final stages J Riddell permitted his mount “Fist” to shift out into the line of “Party Ice” which was checked”. Mr Riddell signed the information admitting the breach and at the beginning of the hearing confirmed that was correct and also that he understood the rule under which he was charged.
Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”.
Facts:
Mr Goodwin using the head-on and side-on films showed the final 200m of the race. He said Mr Riddell was racing adjacent to the running rail with Mr Walker on “Meo” to his outer. Both riders were at the front of the field and riding vigorously as they closed in on the finish. Immediately behind and between Mr Riddell and Mr Walker was “Party Ice” ridden by Mr B Lammas. Mr Goodwin said that as the horses were approximately 20m from the finish Mr Riddell shifted outwards into the line of Mr Lammas. This action caused Mr Lammas to clip a heel and stumble approximately 2 strides after the winning post. He said whilst Mr Riddell was making some effort to keep his horse on a straight line it was not enough to avoid him eventually shifting into the line of Mr Lammas.
To a question from the Committee Mr Goodwin said Mr Lammas’ line had been dictated by Mr Riddell requiring him to take a hold approximately 1-2 strides before the post. He said he did not consider the interference had cost Mr Lammas a better placing and he had run third behind Mr Riddell who won the race and Mr Walker who ran second.
Mr Riddell said his horse had not helped him in the incident. He used the head-on film from the top of the straight and said that as his horse got past Mr Lammas it started to get lost and try to lay out. He said had Mr Lammas been a further half length up on his inside “Fist” would not have been trying to run out as it was. He agreed he was riding vigorously but it was a tight finish and he was trying his best to win the race. He said a lot of the blame had to be put on the horse and he felt that had he attempted to take any corrective action his horse would have still moved out. He also showed the film after the winning post where it could been seen that his horse also stumbled as it was rounding the bend out of the straight to further emphasize his horse was not the easiest of rides.
Submissions for Penalty:
Mr Goodwin said Mr Riddell had been charged twice in 2013 with breaches of the careless riding rule – on 22 February and 30 January. He said he rode predominantly throughout the North Island, was a busy senior rider whose record was considered by the Stewards to be good. He said the Stewards viewed the degree of carelessness to be in the mid range as a horse has clipped a heel notwithstanding the fact that it happened after the finish line. He submitted a suspension of 5 riding days was an appropriate penalty in this case.
Mr Riddell said he thought the interference was minor and that 5 day suspension was harsh considering the incident happened after the line. He also asked the Committee to note that the incident had not stopped Mr Lammas from finishing in a better position. He asked for any suspension to commence after the Queensland Derby meeting in Brisbane on 8 June 2013.
Mr Neal reminded the Committee that Mr Riddell held both a Class A and Class D riders license. he said the Stewards considered all holders of a Class D license, otherwise known as a jumping license, to be national riders during the jumps season as agreed with the Jumping Association (sic).
Reasons for Penalty:
The Committee has reviewed the head-on and side-on films of the incident and taken into account the submissions of both parties. The head-on film clearly shows Mr Riddell on “Fist” moving out approximately 2 strides before the winning post and dictating the line of Mr Lammas. Because of this outward movement Mr Lammas was then seen to clip a heel 1-2 strides after the post. The Committee has noted Mr Riddell’s comments that his horse must share some of the blame for the incident but the responsibility for keeping a horse in a straight line clearly rests with the jockey and had Mr Riddell not moved out Mr Lammas would not have suffered the interference he did.
We believe the severity of the incident is in the low-mid range. We have also noted Mr Riddell’s riding record and whilst this is his third breach of the careless riding rule in 2013 it is his sixth breach of the rule in the previous 12 months.
The Committee believes the interference caused must be reflected in an appropriate penalty which we have decided is a period of suspension. Mr Riddell’s request for a deferral of the suspension is agreed to in terms of Rule 1106(2).
From a starting point of 5 days we have reduced that by 1 day for his admittance of the breach. However, an aggravating factor is that this is Mr Riddell’s sixth breach of the careless riding rule in the past 12 months and because of this we have increased the period of suspension by 1 day.
