As Mr Tanaka admitted the breach the charge was found proved.

Penalty:

Mr Tanaka is suspended for 4 riding days from the close of racing on Wednesday 5 June 2013 to the close of racing on Wednesday 12 June 2013 – the 4 days being New Plymouth (6 June), Te Rapa/Wellington (8 June), Waverley (10 June) and Whangarei (12 June).

Charge:

Following the running of race 3 The “WCM Legal Maiden 2200”, Information A4057 was filed by Stipendiary Steward Mr N Goodwin under rule 638(1)(d). The information stated “that passing the 2000m M Tanaka “Serefino” permitted his mount to shift in when not clear of “Black Dragon” which was taken inwards with consequential interference to “Aria Prince” which was checked”. Mr Tanaka signed the information admitting the breach and at the beginning of the hearing confirmed that was correct and also that he understood the rule under which he was charged.

Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”.

Facts:

Mr Goodwin using the head-on film identified Mr Tanaka on “Serefino” who had started from barrier 8 in the 12 horse field. He said soon after the start Mr Tanaka commenced an inward movement in order to take up a position closer to the rail and approximately 200m after the start he came across in front of Ms Myers on “Black Dragon”. He said Ms Myers received inwards pressure from Mr Tanaka which resulted in her being taken inwards onto “Straight Ahead” (J Riddell) and “Banteneighty” (D Bradley) with consequential interference to “Aria Prince (L Allpress). Mr Goodwin advised that he had spoken to Ms Myers who confirmed she had called out at least twice to Mr Tanaka but he had been unable to relieve the pressure on her. Mr Goodwin estimated that Mr Tanaka was no more than 1 length clear of Ms Myers when the incident occurred.

Mr Tanaka said he was looking around as he came across and confirmed that he had heard Ms Myers calling out to him. He said he thought he was clear of her when he came across and did make an effort to straighten “Serefino” when he realised he was not the required distance clear. He said he had no idea at the time that his movement across in front of Ms Myers had resulted in a concertina affect to the horses on her inside and the resultant check to Mrs Allpress.

Submissions for Penalty:

Mr Goodwin said Mr Tanaka had not been charged with a breach of the careless riding rule for over 12 months during which time he had also ridden overseas in Japan returning from there in August 2012. He said the Stipendiary Stewards assessed the severity of the interference in the low to mid range and he submitted a suspension of 4 riding days was an appropriate penalty in this case.

Mr Tanaka said he had an excellent riding record and reiterated he had tried his best to straighten “Serefino” once he realised he was not the required distance in front of Ms Myers. He asked for any suspension to commence after the Matamata meeting on 5 June 2013.

Reasons for Penalty:

The Committee has reviewed the head-on and side-on films of the incident and taken into account the submissions of both parties. The head-on film clearly shows, and it has not been disputed, that Mr Tanaka commenced to move inwards soon after the start and that after approximately 200m after the start and having looked across at least three times as he came across he put pressure on Ms Myers which resulted in her and three other riders being hampered to varying degrees with the worst affected being Mrs Allpress. The Committee believes Mr Tanaka was no more than his own length clear of Ms Myers at the time of incident.

We believe the severity of the incident is in the mid range because four horses have been affected with the resultant impact on Mrs Allpress being significant as she was checked and lost ground. The impact on her was clear to see in both views of the film but particularly clear in the side-on film.

The interference caused must be reflected in an appropriate penalty which we have decided is a period of suspension. We note Mr Tanaka did not seek a request for a deferral of the suspension.

From a starting point of 5 days we have added on 1 day because the interference has been to four horses. In mitigation we have taken into account Mr Tanaka’s excellent riding record over the past 12 months and his admittance of the breach and are prepared to reduce the suspension from 6 days to 4.
