Decision:
Following the running of race 11, the Tegal Takeouts 1300, D G Bradley the rider of EVA BEAVER was charged with a breach of Rule 871(1) (d). ? Careless riding.
Following the running of race 11, the Tegal Takeouts 1300, D G Bradley the rider of EVA BEAVER was charged with a breach of Rule 871(1) (d). ? Careless riding.
--It was alleged that Mr Bradley rode carelessly when he allowed EVA BEAVER to shift in near the 1,000 metre mark tightening DROVERS CALL (R Stam), A REAL PRINCESS (K Collins), ANZ TIME (T Sasada) and POETS CORNER (K Myers) who had to check.
--Mr Bradley admitted the breach of the rule.
--Prior to hearing submissions on penalty the committee were shown the films of the breach, these demonstrated Mr Bradley improving forward shortly after the start of the race and in doing so move inward and crowd the runners on his inside. These being DROVERS CALL, A REAL PRINCESS, ANZ TIME, and POETS CORNER. The latter being the worst effected.
--Mr Bradley commented on the films, acknowledging that the incident was of his doing however he also illustrated where the effected runners were already in very tight quarters prior to him moving inwards and tightening them further.

PENALTY.
--When making his penalty submission Mr George commenced by presenting Mr Bradley's record, this showing three breaches of the careless riding rule within the past ten months.
--Mr George submitted that this record, combined with the fact that this breach resulted in a number of horses being tightened, warranted a term of suspension being imposed.
--Mr Bradley, when making his submissions readily admitted that he had made an error
--of judgement however he asked the committee to recognise that once he had realised his mistake he had then taken immediate corrective action.
--He then advised the committee of his future riding engagements.
--After carefully considering all submissions in relation to penalty the committee finds that the appropriate penalty in this case is a term of suspension.
--Mr Bradley has allowed his mount to move inward and tighten several runners and as such we feel a term of suspension is warranted.
--With regard to the quantum to be imposed we are mindful that breaches of the careless riding rule generally have, as a base, a starting point of some three to four days to which the aggravating and mitigating factors are then applied. We believe that this is appropriate in this case.
--The aggravating factors are, firstly that this incident involved pressure being applied to several runners, and secondly that this is Mr Bradley's fourth breach of the careless riding rule in the past ten months.
--The mitigating factors are that Mr Bradley has readily acknowledged his error and also that once it has occurred he has taken immediate corrective action.
--Therefore after taking into account all relevant considerations we find that Mr Bradley be suspended from riding from the conclusion of riding on Thursday 4th January up to and including racing on Monday 15th January. A four day suspension.
