The committee is satisfied that had the interference to “Super Sonic” not occurred it would not have finished in front of “Streets Ahead”. Accordingly the protest is dismissed.

The judge’s placings as detailed below stand and authorisation is given for the payment of all dividends and stakes.

Facts:

Following the running of race 3 an Information instigating a Protest was filed by J Riddell the rider of “Super Sonic” which finished 5th in the race alleging interference in the home straight by “Streets Ahead” ridden by A Forbes which finished 4th.

The judge’s placings were:-

1st - Lovetessa (9)
2nd - King Kamada (8)
3rd - Werribee (5)
4th - Streets Ahead (10)
5th - Super Sonic (3)

The relevant margin was 1.25 lengths between 4th and 5th.

Rule 642(1) states:- “If a placed horse or its rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.”

Submissions for Decision:

Mr Riddell using the films available highlighted his mount “Super Sonic” racing adjacent to the running rail at the 350m mark with Mr Forbes on “Streets Ahead” in front of him and to his outer. He said that as the race progressed down the home straight he was making ground on “Streets Ahead” and at a point between the 150m and 100m when the shoulder of “Super Sonic’ was level with the rump of “Streets Ahead” the latter moved inwards causing his horse to “button off” and lose momentum. He felt had he not been required to re-balance his mount he would have beaten “Streets Ahead and finished 4th. To a question from the Committee he said no contact had been made during the incident.

Mr Forbes said there was a gap on his inside all the way down the home straight and Mr Riddell had taken from the top of the straight to past the 150m mark to get a little way inside him. He conceded he had moved in slightly but not enough to affect Mr Riddell’s chances as, in his view, Mr Riddell had only momentarily had to stop riding with the whip.

Mr Greene also made the point that there was always a gap for Mr Riddell to move into from the time the horses rounded the bend at the top of the straight. He said Mr Forbes had moved in near the 100m mark about half a horse width but had immediately straightened his mount. He also said that in the final 100m of the race he did not feel “Super Sonic” was making any ground on “Streets Ahead”.

Mr Neal submitted it was clear from the films that Mr Forbes had shifted in under a hard ride between the 150m and 100m point at which point Mr Riddell was taking ground off Mr Forbes. He said the main issue was whether Mr Riddell was travelling with sufficient momentum that, had the incident not occurred, he would have finished ahead of Mr Forbes. He said Mr Forbes had been leading the field at the top of the straight and others had passed him but not Mr Riddell’s mount despite that horse being under a hard ride.

Reasons for Decision:

It was clear to the committee from the evidence provided by the films and submissions presented that there was inwards movement of about half a horse width by “Streets Ahead” at a point between the 150m and 100m mark which resulted in “Super Sonic” having to be momentarily restrained. In the preceding 200m there had been a gap for “Super Sonic” to move up inside of “Streets Ahead” but “Super Sonic” was only just into that gap when the incident occurred. Mr Riddell said there was no contact. The films show Mr Forbes immediately straightening his mount and Mr Riddell not being able to ride with the whip for 4 strides. The films also show that from the 100m mark Mr Riddell had re-balanced his mount and then used the whip 3 times. However, during the final approximately 50m-70m of the race he did not use the whip at all and was beaten for 4th place by 1.25 lengths.
