Alledged breach of Rule 869 (3) (b).

Facts:

S. Dickson, the driver of Devil Woman, admitted a charge of driving carelessly when he moved his horse out with 350 metres to run resulting in Ten Guitars (T. Mitchell) to be pushed out onto Mia’s Dream resulting in Strike breaking for a few strides. Mr. McIntyre showed the available films of the incident and pointed out that Devil Woman was angled out when there was insufficient room causing the interference and consequently Strike breaking for a few strides.

Mr. Dickson agreed with Mr. McIntyre's comments but did state he thought his horse was hanging in slightly at the point of interference.

Submissions for Penalty:

Mr. McIntyre informed the committee that Mr. Dickson has not been charged under this rule this racing year, and has had over 100 drives. He believed the incident was in the mid range but did ask the committee to take into account two horses were affected, causing Strike to go off stride. He asked for a monetary penalty of between $300 - $350 or a 2 day suspension.

Mr. Dickson indicated that he would favour a fine rather than a suspension and asked the committee to take into account his driving record.

Reasons for Penalty:

Mr. Dickson, in coming to our decision to impose a monetary penalty, we have taken into account your very good driving record and your admittance of the breach. While the incident was in the mid range, horses were affected resulting in one breaking.
