Following the running of Race 1, The PGG Wrightson  Mobile Pace, an information was filed by Stipendiary Steward Mr N Ydgren against J & D J Butcher, Licensed Trainers, alleging a breach of Rule 849 (2) in that CLONEEN was presented to race with the incorrect saddlecloth.

Following the running of Race 1, The PGG Wrightson  Mobile Pace, an information was filed by Stipendiary Steward Mr N Ydgren against J & D J Butcher, Licensed Trainers, alleging a breach of Rule 849 (2) in that CLONEEN was presented to race with the incorrect saddlecloth.

Mr Z E Butcher, Licensed Junior Driver, indicated on the information that he admitted the breach, on behalf of the Defendants, of the Rules and he confirmed this at the hearing.  He also indicated he did not wish to be represented by an Open Horseman.  He further confirmed that he was in charge of a team of three horses including CLONEEN and that he understood the charge and the Rule it was brought under.  Accordingly the charge was found to be proved.

Rule 849 (2) states:-

The trainer, horseman or person in control of each horse in the race shall ensure that the proper numbered saddlecloth is attached prior to the horse parading in the assembly area.

Mr Ydgren informed the Committee that CLONEEN (No 10) had gone out onto the track and prior to completion of its warm up returned to the bird cage as Mr Butcher had realised he had an incorrect saddlecloth (9 instead of 10).  The numbers were changed prior to the start.

Mr Butcher said he had made a mistake and assumed that there were 8 horses on the front row.  As his horse had drawn the inside of the second row he thought it was number 9 in the race book and not number 10 as was the case.

Mr Ydgren recommended a fine of $200. He also pointed out that because today’s meeting was part of a 16 race card with the Wairarapa Racing Club the small gaps between races meant that the Stipendiary Stewards were unable to check the numbers of the horses in each race prior to them going onto the track.

Mr Butcher advised that it was a very busy day for him – he was looking after 3 horses and had four other drives.  He had made a genuine mistake and pointed out that he noticed the error himself during the warm up and returned to the birdcage, had the incorrect number replaced with the correct one and then was able to parade the horse down the straight before the start of the race.

Having regard to Mr Butcher’s admission of the breach and the submissions of the parties Mr Butcher is fined the sum of $150.
