Following Race 1 a protest was lodged by Stipendiary Steward Mr Ydgren alleging that horse No 3 HESMABOY, placed 2nd by the judge, interfered with horse No 2 RAFFINI, placed 4th by the judge.

--

--

The alleged interference occurred at the start.

--

--

Mr P Fergusson was the driver of RAFFINI and Mr S Lawson was the driver of HESMABOY; both horsemen were present at the hearing.

--

--

The Rule was read and both parties acknowledged they understood same.

--

--

Films of the alleged incident were shown and interpreted by the Stipendiary Stewards.

--

--

Mr Fergusson for his part told the Chairman that Mr Lawson’s horse has galloped at the start, came back on his horse which in turn has galloped for a couple of strides.  He added whether or not it would have made any difference at the finish would be questionable as it was in his words “a long way out”.

--

--

Mr Lawson for his part said his horse HESMABOY is not an easy horse to drive, this was confirmed by the Stipendiary Stewards who said the horse was known for its bad racing manners.

--

--

The Stipendiary Stewards, when asked, said they did not wish to reserve the right to charge either horseman involved in the alleged incident.  Those present having nothing further to add left the Judicial Room.

--

--

Having listened to all of the evidence and carefully studied the films shown to him, the Chairman dismissed the protest as he, like Mr Fergusson, felt the interference occurred too far from the finish of the race to establish whether or not it would have affected the final outcome.
