The charge was heard under the SULKY FUND REGULATIONS part of which reads “Significant changes have subsequently been made, including the introduction of a requirement that all sulkies are subject to an annual warrant of fitness and are registered to ensure they are covered within the “SULKY FUND”.

The Chairman had Mr Taumanu read the Sulky Fund Regulations to Mr Phelan and Mr Phelan acknowledged he understood same.

Initially Mr Phelan had not admitted the breach but after hearing the regulations and having same explained to him he changed his mind, admitted the breach and initialled same on the information.

This sulky was in fact Registered but did not have a Warrant of Fitness.

The Stipendiary Steward’s recommended a monetary penalty of $100.00. The Committee felt this appropriate and imposed same taking into account Mr Phelan’s admission of the breach and the fact it was a first offence.
