Decision:

The charge preferred against Mr Tanaka under the provisions of Rule 636(1)(d) was dismissed.

Facts:

Following the running of Race 3 (FRESH CHOICE GREYTOWN MDN), Information No.A9225 was filed with the Judicial Committee. The Informant alleged that Mr Tanaka failed to ride his mount UNBROKEN out to the finish of the Race. (UNBROKEN was beaten for 2nd placing by a half-head).

Rule 636(1)(d) provides:
A person: being the rider of a horse in a race, must ride his horse out to the end of the race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared.

Mr Tanaka advised the Committee that he understood the Rule, the Charge and confirmed that he did not admit the breach.

Submissions for Decision:

Mr Goodwin showed the film replays and said that Mr Tanaka had ridden his mount out with his normal vigour and then with three strides to travel he relaxed his ride. He said that ROCK ISLAND LINE and Mr Hannam who were racing directly in front of Mr Tanaka appeared to ease when about to win the race. He said that both ROCK ISLAND LINE and UNBROKEN were on an inward trajectory.

Mr Tanaka called Mr Hannam as a witness and in response to questioning he said that he did ease before the winning post and that his horse ran inwards over the last few strides of the race.

In answer to a question from the Committee Mr Hannam said that he and his horse had both eased a little.

Mr Tanaka said that he had been riding out and was getting up closer to the heels of ROCK ISLAND LINE. He said that he had to shift inwards to avoid heels. He said that he had no intention to stop riding and only did so to avoid heels and to be safe. He added that his past riding will show that he always keeps riding out to the finish of a race.

Summation
Mr Balcombe said that the side-on film showed that Mr Tanaka had stopped riding out three strides from the winning post hence the reason he was charged. He said that after hearing all of the evidence that perhaps there was some justification for Mr Tanaka taking the action that he did.

Mr Tanaka reiterated that he had had to stop riding and shift inwards to avoid heels to be safe.

Reasons for Decision:

The Committee considered all of the evidence that was presented. The committee also extensively reviewed the head-on and side-on films of the final stages of the race. The side-on showed that Mr Tanaka did stop riding his horse out over the final two to three strides of the race. This was not disputed by Mr Tanaka. Mr Tanaka’s explanation for that course of action being taken was that Mr Hannam’s mount ROCK ISLAND LINE commenced to ease up and at the same time move inwards. The combination of shifting and easing led Mr Tanaka to believe that unless he took evasive action he would have clipped the heels of ROCK ISLAND LINE.

Having considered all of the information put before them, the Committee believed that although the gap between ROCK ISLAND LINE and UNBROKEN was 1.5 lengths, the action taken by Mr Tanaka to ensure that he did not clip heels was considered to be reasonable under the circumstances.
