Facts:
Following the running of Race 2 (AWASSI/CR Grace Maiden Sprint 1200m) Information A6863 was filed with the judicial committee. It alleged that Mr Tinsley "Failed to make weight for RIPE".
Mr Tinsley confirmed that he understood the rule.
Mr Oatham stated that Mr Tinsley had advised the stewards he was unable to make the carded weight of 56.5kg on RIPE. Mr Tinsley advised that his racing manager accepted the ride at a weight that he would not normally accept on a Sunday, having ridden at Trentham the day before, he had found it hard to waste for two days in a row. Mr Tinsley was 1kg over, however the connections had secured another senior rider (Mr Bradley) to ride their horse.
Submissions for Penalty:
Mr Oatham submitted that Mr Tinsley had previous breaches on 13 September at Marton ($250 fine) and 27 September at Taranaki ($200 fine). He also indicated that Mr Tinsley had weight issues in the past and the stewards were not seeking anything more than a $200 fine.
Mr Tinsley submitted that he was riding 4-5 rides a meeting which would equate to about $500. He submitted that if the committee was considering a fine of $500-$600 that he would prefer to take a 1 day suspension rather than the fine.
Reasons for Penalty:
The committee considered the submissions of both parties, and determined that a fine was an appropriate penalty of this occasion. It is clear that Mr Tinsley's record under this rule is not great. The issue of his racing manager accepting a ride that was less than desirable for Mr Tinsley is an internal matter that he and his racing manager need to clarify. Mr Tinsley had an obligation to the connections to fulfil their expectations and he did not do so on this occasion. The committee also determined that a fine at a level that was slightly higher than the previous breach was appropriate.
