As Mr Turner admitted the breach the charge was deemed proved.

Penalty:

Accordingly Mr Turner is suspended from riding from the close of racing on Saturday December 15th up to and including racing on December 21st.

Facts:

Following the running of Race 6 (PGG Wrightson/Leopard Hotel Xmas Cup) an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1)(d) in that jockey D Turner angled his mount outwards near the 800m contacting and forcing NOT ALLOWED wider on the track and hampering CHEESE MAKER.

Mr Goodwin showed all the available videos of the incident and had Mr Balcombe explain what happened. Mr Turner was racing near the rail towards the back of the field when he began to gradually move out onto the mount of Ms R Myers who was racing to his outside. Ms Myers held her position for some distance, keeping Mr Turner in, however he became more forceful. Eventually Ms Myers was moved outwards into the line of CHEESEMAKER who was hampered.

Submissions for Penalty:

Mr Goodwin submitted that the incident was in the low range of careless riding. He said the Stewards did not have a problem with a rider easing another outwards but, on this occasion, Mr Turner had simply displayed a lack of patience. He said Ms Myers was entitled to her line of running.

Mr Goodwin said Mr Turner had incurred 3 suspensions over the previous 12 months but they were all for low level carelessness and this was no different.

Mr Turner explained that he had gradually tried to move Ms Myers outwards but accepted he had ridden carelessly when he moved Ms Myers into the running line of the horse behind.

He advised of riding engagements through until Saturday December 15th.

Reasons for Penalty:

The Penalty guide for Judicial Committees has a starting point of 6 riding days for low level careless riding and we accept that this breach sat at the low end. Mr Turner attempted to ease Ms Myer’s mount out over some distance while she held her line. This was acceptable riding. It was only when Mr Turner used a little more force and eventually managed to gain a run that his actions were considered careless. We note there was no sudden outward movement and the interference received by CHEESEMAKER was relatively minor.

Mr Turner is a busy rider and we considered his record a neutral factor. Taking into account his admission of the breach and all other factors outlined it was the Committee’s opinion that a five day suspension was an appropriate penalty.
