Mr Bishop admitted the breach; therefore the charge was deemed proved.

Penalty:

Accordingly Mr Bishop is fined the sum of $500.

Facts:

Following Race 5, Stipendiary Steward, Mr Goodwin lodged an Information with the Judicial Committee alleging a breach of Rule 638(3)(b)(ii) in that Ryan Bishop used the whip excessively prior to the 100m.

At the outset of the hearing, Mr Bishop confirmed he understood the Rule and that he admitted the breach.

Mr Goodwin used the videos from the top of the straight to show Mr Bishop using his whip for a total 8 times before the 100m mark.

Mr Bishop was satisfied that this number of strikes was accurate.

Submissions for Penalty:

Mr Goodwin said this was Mr Bishop’s second breach of the whip Rule in the last 12 months. He was fined $300 at Wanganui in September for the same number of strikes (8).

Although Mr Bishop won the race the Stewards were of the opinion that he would have done so regardless of the extra strikes.

Mr Bishop agreed that he had no need to use the whip excessively to have won today.

Reasons for Penalty:

The Penalty Guide for Judicial Committees provides the following starting points for breaches of Rule 638(3) (b) (ii):
1st breach - $300
2nd breach - $500
3rd breach - suspension

The Committee considered all submissions. Mr Bishop used his whip 3 times more than allowed. He did not apply undue force and the horse won by a decent margin therefore the Committee did not consider an uplift from the second-breach starting point necessary.

Mr Bishop is well aware that future breaches will likely result in suspension and the Committee urged him to take more care.
