As Mr Hannam admitted the breach, the charge was deemed proved.

Penalty:

Accordingly, Mr Hannam is fined the sum of $300.

Facts:

Following Race 2, Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 638 (3) (b) (ii) in that R Hannam used his whip excessively prior to the 100m on his mount KELLY’S INSPIRATION.

At the outset of the hearing, Mr Hannam confirmed that he understood the Rule and that he admitted the breach.

Mr Balcombe showed on the video where Mr Hannam struck his mount a total of 8 times before the 100m mark. Two of these 8 strikes were in succession. Mr Hannam agreed with the number as shown by the Stewards.

Submissions for Penalty:

This is Mr Hannam’s first breach since all riders’ whip records were reset with the implementation of the new guidelines on October 7th 2019. Mr Goodwin said although Mr Hannam won the race, he did not use his whip continuously or with undue force over the final 100m. The Stewards' submission was for a penalty in line with the new regime.

Mr Hannam was invited to make submissions on penalty but had nothing further to add.

The Penalty Guide for Judicial Committees provides the following starting points for breaches of Rule 638(3) (b) (ii):

1st breach    $300
2nd breach   $500
3rd breach    suspension

The new limit is 5 strikes of the whip before the 100m mark, which meant Mr Hannam was 3 over the guidelines. Taking into account Mr Hannam’s overall use of the whip, the manner in which he used it and the fact that this was his first charge under the new guidelines, it was our opinion that a penalty at the level of the starting point was appropriate.
